Question :

What is the ruling of Sharia on the adjusted local credit fund management instructions in the Ministry of Social Development issued under the Ministry`s management system No. (20/1997)?


The Answer :

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

Having reviewed the adjusted local credit fund management instructions in the Ministry of Social Development issued under the Ministry`s management system No. (20/1997), it was found out that no violations of the provisions of Sharia were committed therein.

However, we must point out that the phrase "Conventional bank" was repeatedly used in several articles of the contract while Sharia requires that deposits are to be made in Islamic banks only.

In conclusion, the contract of the credit funds is valid, has its Sharia implications, but the above remarks must be taken into account. Moreover, those in charge of this system are responsible for the proper application of the conditions stated therein. And Allah the Almighty knows best.
