Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
Having reviewed the contract for (Cancer Care Insurance) provided by the late King Hussein Cancer Foundation, it became evident that the contract is based on cooperative (takaful) insurance. In principle, the Sharia ruling regarding this type of insurance is permissibility, as it involves cooperation in righteousness and piety. Allah the Almighty says {What means}: "Help ye one another in righteousness and piety, but help ye not one another in sin and rancor." {Al-Ma`idah, 2}. The Prophet (PBUH) said, "When the people of Ash`ari tribe ran short of food during the holy battles, or the food of their families in Medina ran short, they would collect all their remaining food in one sheet and then distribute it among themselves equally by measuring it with a bowl. So, these people are from me, and I am from them." {Transmitted by Bukhari & Muslim}. This is the general opinion held by the majority of Islamic jurisprudential assemblies and contemporary fatwa bodies.
We have not come across any Sharia-compliant reasons that would necessitate the prohibition of the contract, and the responsibility for the correct implementation of the contract's conditions lies with the management of the Foundation.
In conclusion, there is no Sharia-based objection to participating in the mentioned contract with the intention of mutual cooperation, and the responsibility for the correct implementation of the contract's conditions lies with the management of the Foundation. And Allah the Almighty knows best.
