Resolution No. (295) (15/2020): "Ruling on Investing Part of an Endowed Land which is Unsuitable as Burial Ground"

Date: (16th of Rabi'ul-Akhir, 1442 AH), corresponding to (2/12/2020 AD).

 

 

All perfect praise be to Allah, the Lord of the Worlds; may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

In its 13nth meeting held on the above date, the Board reviewed the letter No. 4/6/2/13262 sent from His Excellency the former Minister of Awqaf, Holy Sites and Islamic Affairs Dr. Abdulnaser Abulbasal. It reads as follows: Is it possible to invest part of the endowed land No. (100)-(7-Al-Wid al-Gharbi of al-Hashimiyah lands) on which An-No`man Bin Miqrin`s Mosque and an ancient graveyard are established ? It is worth pointing out that the part intended for investment is rocky ground, doesn`t have graves, and is unsuitable for burial. Moreover, this part is around 1000 square meters, located in a residential area, surrounded by several streets, and outside the Mosque`s wall. In addition, the municipality has closed this graveyard because this part, being rocky ground, is unsuitable for burial.

After careful consideration, the Board has arrived at the following decision:

Since this endowed land serves the purpose for which it was endowed in the first place, which is establishing the Mosque and burying the dead, then it is permissible to invest the rocky part, which is unsuitable for burial, and use the revenue for the benefit expected from this Waqf (Endowment). In addition, Resolution No. (23/2014) issued by the Board of Iftaa`, Research and Islamic Studies contains this same content. And Allah The Almighty Knows Best.

Is it permissible to offer Tahajjud prayer after Witr prayer?

It is permissible to offer voluntary prayer after Witr (An odd number prayer performed between Isha and Fajr) prayer. However, it is desirable that the night prayer be ended with Witr. Therefore, it is desirable for one, who thought that he was most probably going to wake up at night in order to offer Tahajjud, to offer Witr after it, but one, who fears that he might not wake up, should offer Witr before going to bed.

Is it a condition that one should offer two sacrifices for a male newborn?

It is desirable to offer two sheep for a male newborn, and one for a female newborn. Offering one sheep for the male newborn is also permissible as it observes the Prophet`s Sunnah in this regard.

My father placed shares worth twenty dinars in one of the banks, and their value doubled to become five thousand dinars. When my father passed away, one of the scholars told us that it is permissible for us to take the money. What is the ruling on this money, considering that it comes from a bank and involves interest (Riba)?

Allah The Almighty Said (What means): "And if you repent, then for you is the principal of your wealth. You do not wrong, nor are you wronged." [Al-Baqarah/279]. This is the precautionary ruling regarding what you are asking about. You are entitled to the principal amount, and you should give the excess as charity to the poor and needy. If you are poor, you may take from it. And Allah The Almighty Knows Best.

What is the ruling of Sharia on unregistered marriage in Jordan?

Aishah narrated that the Messenger of Allah said: "Whichever woman married without the permission of her Wali her marriage is invalid, her marriage is invalid, her marriage is invalid. If he entered into her, then the Mahr is for her in lieu of what he enjoyed from her private part. If they disagree, then the Sultan is the Wali for one who has no Wali." [At-Tirmithi, Hadith No.1102]. The Prophet (PBUH) also said: "There is no marriage without a guardian and two honorable witnesses." Related in [Al-Mo`jam Al-Basit for At-Tabarani, pp.6366]. Registration of the marriage contract at Islamic court is necessary for the preservation of rights and failing to do so is punishable by Jordanian Law. And Allah The Almighty Knows Best
