Resolution No.(249): "Ruling on Inviting Doctors to Attend Scientific Conferences and Meetings"

Resolution No. (249)(18/2017) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Inviting Doctors to Attend Scientific Conferences and Meeting"

Date: (2/ Rabie` 2nd/1439 AH), corresponding to (21/11/2017 AD).

 

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all His family and companions.

On the above date, the Board received a question sent from a Jordanian citizen to the Electronic Website of the General Iftaa` Department. It stated as follows:

What is the ruling of Sharia on the invitations sent to doctors by pharmaceutical companies to attend scientific conferences overseas, knowing that travel and accommodation expenses are covered by the companies themselves? Also, what is the ruling on inviting doctors to scientific lectures accompanied with a fancy business lunch or dinner at a state hotel?

After deliberating, the Board arrived at the following decision:

It is permissible for doctors to take sample medications offered by representatives of pharmaceutical companies as well as attend academic conferences, provided that they adhere to the following rules of Sharia and the medical profession:

First: It doesn`t affect the doctor`s decision in prescribing the medication that suits the patient`s condition.

Second: The doctor takes the financial condition of the patient into consideration.

Third: The doctor adheres to the rules and regulations governing this sector in the ministry or party with whom he works. 

Fourth: The doctor`s aim is to achieve progress in his field of specialty and benefit the patients.

In conclusion, treatment is the responsibility of the doctor before Almighty Allah. He/she should observe the rules of Sharia and the moral code. Therefore, if the afore invitations and conferences could undermined his/her adherence to the above rules, then they should be turned down. And Allah Knows Best.

What is the ruling on eating or drinking forgetfully during the day in Ramadan or during voluntary fasting?

Whoever eats or drinks forgetfully while fasting, whether in an obligatory or voluntary fast, should continue their fast, for it is Allah who has provided them with food and drink. There is no difference between obligatory and voluntary fasting in this ruling.

What is required of a traveler or a sick person if they broke their fast and then their excuse ceased?

If a traveler settles or a sick person recovers after having broken their fast, it is recommended for them to refrain from eating and drinking for the rest of the day, but it is not obligatory.

What is the ruling on eating or drinking during the second Adhan?

It is not permissible to eat or drink during the second Adhan because it announces the break of dawn and the obligation to start fasting. Allah Almighty says {what means}:"and eat and drink until you can discern the white streak of dawn against the blackness of night." [Al-Baqarah/187].
Whoever eats or drinks during this time invalidates their fast, and they must refrain from eating for the rest of the day and make up for the missed fast later.

 

I work overtime after regular working hours and may become occupied with my phone or the work computer for personal matters — what is the ruling on this?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is obligatory upon an employee to abide by the instructions and regulations governing overtime hours, and equally obligatory to uphold honesty and avoid all forms of deception and dishonesty. Allah the Almighty says {what means}: "O you who have believed, be mindful of Allah and be with the truthful." [Al-Tawbah/ 119]
Whoever is assigned to work overtime must be present at his workplace — even if he has no specific tasks to carry out at that time. In such a case, he should strive as best he can to spend that time in a manner that benefits the institution he works for. If there is genuinely no work for him to do, there is no objection to occupying his time with something beneficial — such as reciting the Holy Qurʾān, reading, or listening to educational lessons — provided he has already completed all the responsibilities assigned to him.
If, however, he does have work to complete, he must spend that time fulfilling it. He may attend to phone calls or other personal matters to the extent that is customarily acceptable, as long as this does not result in delaying or postponing his work. If he delays his work on account of personal preoccupations, the wages he received for that wasted time are not lawfully his to keep, and he is obliged to return the equivalent amount to the institution by whatever means available to him. And Allah the Almighty knows best.
