Resolution No.(131),(9/2009): “On Virginity Test”

Date: 1/8/1430 AH, corresponding to 23/7/2009 AD.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

 

During its third session held on the above date, the Board of Iftaa` reviewed the news reported by some local newspapers that the Director of the National Center for Forensic Medicine stated that large numbers of girls have visited the Center to make sure that they are virgins.

We have asked him about that piece of news through an official letter, and he said that it was inaccurate and that such a test is conducted only upon the request of judicial bodies when they have a case that requires such a thing, and the judge needs to know the truth, so he asks for a report in this regard from the Center. No suitor has ever asked his finance to undergo such an examination. Based on what the Director of the Center said, the Iftaa` Board holds that conducting such a test is permissible when demanded by judicial bodies, and that isn`t considered an accusation to honorable women. However, it should be conducted by a female doctor.

Conducting such a test upon the request of the suitor-although the Director of the Center confirmed it has never happened-is prohibited and the same rule applies to the request itself. This is because uncovering the private parts of men and women is permissible only in case of necessity or dire need as is  the situation mentioned by Center`s Director.

The Board confirms that our society is too honorable and noble to treat young women in such a disrespectful manner, because their honor and pride doesn`t tolerate  such humiliation. On our part, we warn against circulating any piece of news that could stigmatize our Islamic nation and we remind people that Allah Says (what means): “Those who love (to see) scandal published broadcast among the Believers, will have a grievous Penalty in this life and in the Hereafter: God knows, and ye know not” {An-Noor/19}. Is it permissible for the guardian to give Sadaqa (voluntary charity) from the money of the orphans?

It is impermissible for the guardian to donate from the money of the orphans because he is entrusted with the safekeeping of that money, and is prohibited from donating it.

Is it permissible for a person, who vowed to offer two Rak`ahs (units of prayer) everyday for Allah`s sake, to do so after the Fajr (dawn) prayer?

In principle, a vow should be fulfilled as it was originally intended, and if its time lapses then, it should be fulfilled at any time because of the vow. Therefore, it is permissible to offer them after the Fajr prayer, and there is no prohibition in doing so. However, it is preferable for him to offer these two Rak`ahs at some other time to avoid the disagreement amongst the scholars in this regard.

Is it permissible for a woman to inherit the same share as of a man?

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Muhammad and upon all if his family and companions.                                                                                                                                                                                                 Thorough studies in which woman's right to inherit according to law of distribution of estate indicates that there are more than one case by which women inherit the same as man and sometimes much more, or to shed the lights regarding the right to inherit while men who share the same family line with her don't have the right to inherit because the deceased has closer ties of kinship with her. In addition to four cases whereas woman inherits half share in comparison with man's share although they had the same degree of kinship with the deceased. For further details as regards the latter cases, kindly refer to elaborated jurisprudence books. And Allah Knows Best.

 

 

Is it enough to say Tasbeeh (Saying Subhaana Rabbiya Al-‘Atheem during Rukoo`, and saying Subhaana Rabbiya Al-A‘laa during Sujood ) once, or twice during Rukoo`(Bowing in prayer) and Sujood (Prostration)?

All perfect praise be to Allah, The Lord of The Worlds                                                                                                                                                                  Yes, saying Tasbeeh once during Rukoo` and Sujood is enough, provided that the worshiper`s attentiveness of the heart isn`t undermined during each. As regards the recompense, it depends on the number of Tasbeeh. And Allah Knows Best.
