Resolution No.(67): "Ruling on Dividing Land in Accordance with Tameem Ad-Dari`s Endowment"

Date: 23/5/1424 AH corresponding to 23/7/2003 AD.

 

The Board received the following question:

How to divide an inherited plot of land {Waqf Tameem Ad-Dari type} amongst eligible heirs, taking into consideration that it is located within the borders of Al-Khalil Municipality. Is it possible to divide it according to Sharia, or the Ottoman Land Code?

Answer: All success is due to Allah.

After deliberation, the Board is of the view that the revenue of the aforementioned plot and the structure on it is to be divided according to Sharia, and not the Ottoman Land Code. This is because it isn`t a miri land stated in the Ottoman Land Code, rather, it is registered as an endowment of Tameem Ad-Dari`s type, located within the borders of Al-Khalil Municipality. What is the Islamic ruling regarding a person finding buried treasure, whether gold or artifacts, and what is their share of it?

If the buried treasure is Islamic, it is considered Luqta (lost property), and the finder must announce it to locate its owner. If all efforts to find the owner fail, the finder may take ownership of it. If the treasure is non-Islamic and consists of gold or silver, zakat must be paid on it, which is one-fifth of its value. And Allah Knows Best.

Is it permissible for the wife to give the Zakah (obligatory charity) of her money to her poor husband?

Yes, it is permissible for the wife to give from the Zakah of her money to her poor husband. And Allah Knows Best.

Is photography forbidden, such as photographs of children?

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
If there is a need for taking photographs of children or adults, then this is allowed. However, taking photographs of women shouldn`t be tolerated. Rather, they must be taken while wearing Hijab and must be kept in safe hands. And Allah The Almighty Knows Best.

Is it disliked to clip one`s nails at night, and to burn them afterwards?

It is recommended to bury hair and nails that have been removed and to conceal them in the ground. As for burning nails, we have not found any specific prohibition against it, but adhering to what is supported by evidence—burying the nails—is preferable. And Allah Knows Best.
