Article (1):

This regulation shall be cited as "Al-Iftaa` Personnel Regulation System/2008 "and shall come into effect after the date of its publication in the official Gazette.

 

Article (2):

The following words and expressions, wherever used in this Regulation, shall have the meanings hereunder assigned to them, unless the context otherwise provides:

 

-The Grand Mufti: Grand Mufti of the Hashemite Kingdom of Jordan.

-The Department: General Iftaa` Department.

-The Secretary General: Secretary General of Iftaa` Department

-The Mufti: Any Mufti at the Department or its branches in governorates.

-The Mentor: Family mentor at the Dept. or governorate.

-The Researcher: Any researcher at the Dept. or governorate.

 

 

Article (3):

Salaries and raises of Iftaa` employees shall be as follows:

A-The Grand Mufti shall receive the salary and allocations of a Minister, in addition to (1500JDs) per month as an allowance for representing Al-Iftaa`.

B-The Secretary General shall receive the salary given to occupants of second class positions of the high category and the raises stipulated in the effective Civil Service Regulation, and an additional raise of (115%) from the basic salary.

C-A Mufti shall receive the following salary, annual increase and additional raise with a percentage from the basic salary:

D-Occupants of the  positions mentioned in this article(3) shall receive (40 JDs), per month, as an individual allowance, in addition to the family allowance stipulated in the effective Civil Service Regulation.

 

 

Article (4):

The Mufti shall be hired in accordance with the following requirements:

 

A-One who holds a BA in Sharia Sciences, at least (10) years have passed over his receiving this degree and have passed the tests conducted by the Iftaa` Council shall be given the salary of the first year based on the sixth degree. This is provided that years of experience, other than the ten years, are calculated. In addition, he shall be granted one annual increase for the first five years.

B-Master degree holders shall be granted two annual increases; whereas, PhD. holders shall be granted three annual increases.

C-By decision of the Iftaa` Council, the situations of the Muftis appointed before the provisions of this regulation were put into effect shall be adjusted, and in accordance with them.

 

Article (5):

A-An employee occupying the position of mentor and researcher shall be given an additional raise with a percentage of(100%) from the basic salary which he collects in accordance with the provisions of the effective Civil Service Regulation.

B-The rest of the Department`s employees shall be given an additional raise with a percentage of (50%) from the basic salary that each receivesin accordance with the provisions of the effective Civil ServiceRegulation.

C-It is permissible, by decision of the Iftaa` Council, to give bonuses to researchers against conducting research, entrusted to them, based on instructions issued by the Grand Mufti to that end.

 

Article (6):

In cases not stipulated for in this regulation, the effective Civil Service Regulation shall apply to the Department`s employees. To this end, the Iftaa` Council shall exercise the powers of the cabinet, and the Grand Mufti shall exercise the powers of the minister stipulated in this regulation.

 

Article (7):

Any text stipulated in another regulation that contradicts the provisions of this regulation shall not be effective.

 

Article (8): The Grand Mufti shall issue the necessary instructions for the execution of the provisions of this regulation.

The Prophet ﷺ taught us to observe I‘tikaf in the last ten nights of Ramadan, seeking Laylat al-Qadr. Whoever worships Allah and revives this night will receive the reward of worshiping for a thousand months—excluding Laylat al-Qadr itself.

What is the ruling of Islamic Law on a fictitious marriage for the purpose of obtaining citizenship?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
There is no such thing in our noble sharīʿah as a "nominal" or "fictitious" marriage or divorce. Marriage and divorce are among the sacred ordinances of Allah, and it is not permissible to manipulate them or use them as a stratagem to obtain worldly gains.
The foundational purpose of a marriage contract is the permanence and continuity of the relationship between the spouses — to establish a family, and to bring forth righteous offspring. So sacred is this bond that Allah the Almighty Himself described it as a solemn covenant (mīthāq ghalīẓ), saying {what means}: "And if you wish to replace one wife with another and you have given one of them a great amount of wealth, do not take any of it back. Would you take it in injustice and manifest sin? And how could you take it while you have gone in unto each other and they have taken from you a solemn covenant?" [Al-Nisāʾ/ 20–21]
Accordingly, it is not permissible to resort to manipulation and deception in contracts that Allah, Mighty and Majestic, has described as a "solemn covenant" — all for the sake of material and worldly benefit. Marriage is built upon permanence and does not admit of a fixed time limit. If a time limit is stipulated in the contract, the contract is rendered invalid by the consensus of the jurists. Similarly, marriage is impermissible when there exists a mutual, concealed intention to limit its duration — even if no time limit is explicitly mentioned in the contract — for this constitutes a form of unlawful circumvention of the sharīʿah. This is to say nothing of the lying and deception that such conduct involves, the prohibition of which needs no elaboration. Lying, deception, and fraud for the purpose of obtaining worldly gains are among the gravest of sins.
If, however, the marriage contract is first concluded in a valid sharʿī manner and then registered civilly, it is sound and fully valid. And Allah the Almighty knows best.

What is the ruling of Islamic Law on the prayer of zawal?

 

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is recommended (sunnah) to pray four rakʿāt — either with a single tasleem or as two separate sets of two rakʿāt — immediately following the sun's decline from its zenith (zawāl). This prayer is distinct from the regular Sunnah prayer of Ẓuhr (sunnat al-ẓuhr al-rātibah), as explicitly stated by the Shāfiʿī jurists.
It is mentioned in Nihāyat al-Muḥtāj: "The prayer of zawāl is offered after the sun's decline — so were one to perform it before that, it would not count. It consists of two or four rakʿāt and is distinct from the Sunnah of Ẓuhr, as is evident from the fact that it is mentioned separately after the regular Sunnah prayers, and it becomes a make-up prayer (qaḍāʾ) if a long period of time passes by customary reckoning... Al-ʿAlqamī stated: 'Scholars refer to this as the Sunnah of Zawāl, and it is distinct from the four rakʿāt that constitute the Sunnah of Ẓuhr.' Our shaykh said: Al-Ḥāfiẓ al-ʿIrāqī stated that among those who explicitly affirmed its recommendation was al-Ghazālī in al-Iḥyāʾ, in the chapter on devotional litanies, noting that there is no tasleem between them — meaning there is no break between each pair of rakʿāt."
The time of the sun's decline (zawāl) marks the very beginning of the time for the Ẓuhr prayer.

Should the Zakah (obligatory charity) giver tell the poor recipient that this is the Zakah of his money?

No, he shouldn`t. But, the Zakah giver should make an intention in his heart that it is the Zakah of his money when paying it to the poor. And Allah Knows Best.
