The Prophetic Migration... A Journey of Building a Firmly Established State

All praise is to Allah, Lord of the worlds, and may peace and blessings be upon our Master Muhammad, his family, companions, and followers.

In these blessed days, we breathe in the fragrance of that sacred journey overflowing with messages and lessons—the anniversary of the Prophetic Hijrah.

The noble Hijrah was the journey of building a strong state with its institutions: its mosque, its army, and its economy. A state strong in the firm faith of its people—a state that would protect the religion and safeguard its citizens who defend their faith, identity, land, honor, and resources.

This beginning, this strength, and this divine empowerment explain to us the secret behind that enmity—the reason why the disbelievers of Mecca shifted from merely persecuting the Prophet (peace and blessings be upon him) and his noble companions to conspiring to kill him once they learned of his intention to migrate and establish a state.

A strong state with a firm identity that defends its faith, people, and resources has always—and will always—infuriate our enemies across time and place. That is why their tactics shifted from oppression, economic warfare, and propaganda to outright intent to kill.

They conspired to assassinate the Prophet (peace and blessings be upon him) as stated in the following verse (What means): "And [remember, O Prophet] when the disbelievers plotted against you to detain, kill, or expel you. They planned, but Allah also planned. And Allah is the best of planners." [Al-Anfal/30].

The use of the word "plotted" indicates that the disbelievers persist in their schemes and hostility. Their plotting against this religion continues—against our sacred symbols, against our major causes and beliefs, and against this Ummah, its principles, and its identity. We see it today: militarily, as we witness in the oppression of our people in Palestine; intellectually, in the waves of atheism, skepticism toward the sources of Islamic rulings, and attacks on the Qur’an, Sunna, and scholars; and morally, in the campaigns promoting deviance in relationships, opposing Islamic rulings. All of this is part of their plotting. Yet the verse reminds us that the schemes of Allah’s enemies hold no weight or value.

Today, as Allah Has Blessed us with this sacred land and the blessings of security and faith, it is our duty to safeguard these favors. We must understand that preserving them is a defeat for our enemies. We must recognize that the Qur’an, Sunna, and divine rulings are the guarantees of our nation’s strength and unity. May Allah protect Jordan and perpetuate its honor under the blessed Hashemite banner, led by His Majesty King Abdullah II Ibn Al-Hussein.

We ask Allah The Almighty to grant us victory and to firmly establish the religion He has chosen for us. Indeed, He is The Guardian of that and The All-Powerful over it. And all praise is to Allah, The Lord of The Worlds.

Summarized Fatawaa

What is the ruling on the use of an inhaler by a *muḥrim* (a person in the state of *iḥrām*)? [An inhaler is a medicinal device used for inhalation, containing various herbal ingredients.]؟

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is permissible for the muḥrim (a person in the state of iḥrām) to use incense (bakhūr), sprays, and inhalers that contain aromatic substances for the purpose of treatment, because the intention is medical treatment, not the use of perfume (taṭayyub). No expiation (fidyah) is required of him for doing so.
It is stated in Ḥāshiyat al-Bujayrimī ʿalā al-Khaṭīb (Vol.2/p.455): “That which is intended for eating or for medical treatment, even if it has a pleasant scent, such as apples, spikenard (sunbul), and the various fragrant spices such as mastic (muṣṭakā), is not forbidden, and no fidyah is due for it, because what is intended for eating or treatment carries no fidyah.”. And Allah Almighty knows best.

What is the ruling of Islamic Law on a father shaking hands with his son’s wife after she has been divorced three times?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
The wife of one’s son is among the women permanently prohibited to the husband’s father as soon as the marriage contract  is concluded, based on the saying of Allah the Exalted: “Prohibited to you are your mothers, your daughters, your sisters, your paternal aunts, your maternal aunts, your brother’s daughters, your sister’s daughters, your foster mothers, your foster sisters, your wives’ mothers, and your stepdaughters under your guardianship [born] of your wives with whom you have consummated marriage. But if you have not consummated marriage with them, there is no sin upon you. [Also prohibited are] the wives of your sons who are from your loins, and that you take [in marriage] two sisters simultaneously, except for what has already occurred. Indeed, Allah is ever Forgiving and Merciful.” [al-Nisāʾ/23]
This prohibition begins once the son’s marriage contract with his wife is complete, and it remains in force even if the son separates from her before consummation or before any seclusion (khalwah) with her. It is therefore permissible for the father to shake her hand and to be alone with her, provided there is no fitnah (temptation) and no suspicion.
It is stated in ʿUmdat al-Sālik (p. 204): “It is forbidden to marry… the wives of one’s fathers and of one’s sons. All of these women become prohibited by the mere contract, … all of that being a permanent prohibition.” End quote, with slight adaptation. And Allah Almighty knows best.

What is the ruling on praying in congregation at the mosque?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

Congregational prayer (Salat al-Jama‘ah) is a communal obligation (Fard Kifayah) for resident men regarding the performance of the prescribed (obligatory) prayers. For men, praying in congregation at the mosque is better than praying elsewhere, such as at home. On the authority of Abdullah bin Umar, the Messenger of Allah ﷺ said: 'Prayer in congregation is twenty-seven degrees more excellent than the prayer of a person alone' (Reported by Bukhari & Muslim). Furthermore, on the authority of Abu Hurayrah, the Messenger of Allah ﷺ said: 'Shall I not tell you that by which Allah erases sins and raises ranks?' They said, 'Of course, O Messenger of Allah.' He said: 'Performing wudu thoroughly despite difficulties, taking many steps toward the mosques, and waiting for the next prayer after the prayer; that is your Ribat (steadfastness)' (Narrated by Muslim).

As for a woman, her praying in congregation at home is better for her than in the mosque, according to the saying of our Master the Prophet ﷺ: 'Do not prevent your women from attending the mosques, but their homes are better for them' (Narrated by Abu Dawood). Young boys should be encouraged to attend the mosques and congregational prayers so they may become accustomed to them. And Allah the Exalted knows best.

What is the ruling of Islamic Law regarding one who slaughters a ewe and it turns out to have been pregnant, and is it permissible to slaughter the ewe if one knows it is pregnant?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
If a person slaughters a ewe and it turns out to have been pregnant, the fetus becomes lawful (ḥalāl) by virtue of its mother's slaughter (tabaʿan li-ummihā).
It is stated in Mughnī al-Muḥtāj (Vol.6/P.158): "A fetus found dead [after the mother's slaughter], or found alive but in a state resembling that of a slaughtered animal [i.e., dying shortly after], becomes lawful — whether or not it had grown fur — provided it is found in the womb of a mother that was lawfully slaughtered, whether her slaughter was by cutting the throat, or by an arrow or hunting dog sent after her. This is based on the ḥadīth: 'The slaughtering of the fetus is [effected by] the slaughtering of its mother' [narrated by al-Tirmidhī, who graded it ḥasan, and by Ibn Ḥibbān, who graded it ṣaḥīḥ] — meaning that the slaughter which rendered the mother lawful renders the fetus lawful as well, by virtue of following her; and because the fetus is one of her constituent parts, and her slaughter renders lawful all of her parts."
This ruling differs, however, from the case of one who knows from the outset that the ewe is pregnant [and intends to sacrifice her specifically as the udḥiyah while pregnant] — in which case, according to the Shāfi'ī school, she does not fulfill the requirement of a valid sacrifice.
It is stated in Ḥāshiyat al-Bujayrimī 'alā al-Khaṭīb (Vol.4/P.335): "A pregnant animal does not fulfill the requirement [of a valid sacrifice], and this is the authoritative position (al-mu'tamad), because pregnancy diminishes the quality of the meat. As for why such an animal is nevertheless counted as complete [i.e., fully valid] in matters of zakāh, that is because the intent there is reproduction (nasl), not the quality of the meat.". And Allah, the Most High, knows best.
