Relieving the People of Gaza is a Legal Obligation

"In the name of Allah, the Most Gracious, the Most Merciful"

Abu Hurairah [RAA) narrated that the Messenger of Allah (PBUH) said:

“……. A Muslim is a Muslim’s brother. He does not wrong, desert or despise him……..” {Related by Muslim}.

The General Iftaa` Department extends its sincere thanks to the Jordan Hashemite Charity Organization and the Royal Medical Services for their fulfillment of the collective obligation incumbent on all Muslims, and their continuous and organized provision to our brothers in Gaza - based on the royal directives - with some of the requirements of daily life: food, medicine, treatment, and clothing. This helps our brothers in Gaza to stand firm in the face of the difficult circumstances they face.

We urge all Muslims to cooperate with the Jordan Hashemite Charity Organization in sending aid to our people in Gaza. Indeed, it is Allah Who grants success.

Summarized Fatawaa

What is the ruling on selling sacrificial animals (udhiyah) described with specific attributes and authorizing an agent to slaughter them?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

Selling sacrificial animals (udhiyah) that are described with specific attributes is permissible. This falls under the category of a salam sale (forward sale) if conducted using the terminology of salam, and under the category of a regular sale if not using the terminology of salam.

As for authorizing the seller to slaughter the sacrificial animal, the basic principle is that it is permissible, because the agent (wakil) stands in the place of the principal (muwakkil) in achieving his objective. This is a contract that the principal (the buyer) is entitled to perform himself, so authorizing another (the seller) to do so on his behalf is valid.

However, it is a condition for authorization to slaughter that the intention (niyyah) is present either at the time of slaughter or at the time of handing over the sacrificial animal to the agent. The basic principle is that the sacrificial animal must be specifically designated, as it is an act of worship. It is not required to designate it at the time of slaughter; rather, it is valid to do so before that.

It is permissible for the principal either to delegate the intention to the agent or to formulate it himself when authorizing the agent to slaughter. However, the sacrificial animal must be designated, even if at the time of slaughter, by the agent.

It is obligatory to designate the sacrificial animals so that each person offering a sacrifice receives his own specific animal. Therefore, charitable organizations and companies must take this into consideration and establish a specific mechanism that ensures no mixing of sacrificial animals occurs, so that each person offering a sacrifice receives his own designated animal. And Allah Almighty knows best.

For some time I have been searching for a guiding shaykh to teach me the spiritual path (*sulūk*) and the Islamic sciences, but I have not found one. What should I do?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
There is abundant good in this Ummah, and the scholars who guide and nurture are never cut off. The student of knowledge should strive in seeking them out, ask diligently after them, and draw from their learning.
As for one who cannot find a guiding and nurturing shaykh, he should send abundant prayers and peace upon our master the Prophet (peace and blessings be upon him), while keeping constantly to dhikr and worship and abstaining from the forbidden. For that will bring him to his goal in traveling toward Allah the Exalted. Imam Muḥammad al-Sanūsī (may Allah have mercy on him) said: “I have seen it said by some of the imams of Sufism that whoever lacks shaykhs of spiritual training (shuyūkh al-tarbiyah) should increase his invocation of blessings upon the Prophet (peace and blessings be upon him), for by it he will reach his goal.”
The scholar Aḥmad Zarrūq al-Mālikī (may Allah have mercy on him) said in Qawāʿid al-Taṣawwuf (p. 86), rule no. 114: “Dhikr is the decree of sainthood (manshūr al-wilāyah). Whoever is given dhikr has been given the decree. Our shaykh Abū al-ʿAbbās al-Ḥaḍramī (may Allah be pleased with him) said: ‘Keep constantly to dhikr and abundant blessings upon the Messenger of Allah (peace and blessings be upon him), for it is a ladder, an ascent, and a path to Allah the Exalted when the seeker does not meet a guiding shaykh.’” And Allah Almighty knows best.

What is the ruling on making up the regular *rawātib* (sunnah) prayers together with a missed obligatory prayer?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is obligatory to make up (qaḍāʾ) a missed obligatory prayer (farḍ). As for the timed supererogatory prayers (al-sunan al-muʾaqqatah) or the regular rawātib prayers, it is recommended (mandūb) to make them up, even if a long time has passed. Ibn Ḥajar (may Allah have mercy on him) said in his Fatāwā: "It is established in our school that it is sunnah to make up the timed voluntary prayers, by night or by day, even if congregation is not prescribed for them, whether much time has passed or little."
Accordingly, it is recommended to make up the sunan together with the obligatory prayer. And Allah Almighty knows best.
________________________________________
Note on terminology: Al-nawāfil al-muʾaqqatah (timed voluntary prayers) refers to supererogatory prayers tied to a specific time or cause, such as the rawātib (regular prayers before and after the obligatory ones), Duha, and the like. The ruling given here reflects the Shāfiʿī position.

What is the Islamic ruling on smearing the head of the newborn with the blood of the `Aqiqah?

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
It is disliked (makrūh) to smear the head of the newborn with the blood of the 'aqīqah, as this is a practice that belongs to the customs of the pre-Islamic era of ignorance (Jāhiliyyah). What is Sunnah instead is to anoint the newborn's head with saffron or another pleasant fragrance. And Allah Almighty knows best.
