The Terrorist Crime in America and Libya

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

The General Iftaa` Department ascertains that the killing of the innocent based on religious, sectarian or racial affiliations poses a serious threat to all humanity and a transgression rejected by Islam, the religion of mercy and human dignity. Allah says {what means}: "We sent thee not, but as a Mercy for all creatures." {Al-Anbiya`, 107}. He also says {What means}: "We have honoured the sons of Adam;" {Al-Israa`, 70}.

The Department strongly condemns the heinous crime that took place in the United States and led to the death of three Muslims. It also condemns the horrible crime in which a number of Egyptian Coptic Christians were beheaded in Libya. A crime so abhorring that it shook the world conscience. However, these stonehearted criminals don`t represent Islam and Islam is innocent from them.

Accordingly, the Department calls on scholars, thinkers and opinion influencers to stand up to extremism, display the true luminous image of Islam and prevent the attack against it. This is since mistaking Islam for extremism disrupts and destroys human societies. We ask Allah to bless our beloved country, along with other Muslim countries, with peace and security.

Summarized Fatawaa

What is the ruling on someone who eats or drinks thinking that the night is still present, then realizes that dawn has broken?

Whoever eats or drinks thinking that the night is still present, then later discovers that dawn has broken, must refrain from eating and drinking for the rest of the day out of respect for the sacred month. However, they must make up that day after Ramadan, and there is no sin upon them.

What is the ruling of Islamic Law on shaving body hair and clipping the nails for one who is in a state of major ritual impurity (*junub*)?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is recommended for one in a state of major ritual impurity (junub) not to remove anything from his body until after the ritual bath (ghusl). It is stated in Bushrā al-Karīm bi-Sharḥ Masāʾil al-Taʿlīm (p. 135): “It is recommended for one in a state of janābah and the like not to remove anything from his body until after ghusl, because the parts of the body return to him in the Hereafter, and he returns in a state of janābah, as a rebuke to him. Then it is removed from him, except for the original parts. It is said that every hair demands its due for its janābah.”
It is stated in Ḥāshiyat al-Shabrāmallisī ʿalā Nihāyat al-Muḥtāj (Vol.2/p.341): “If he wishes to combine shaving and the Friday ghusl, he should delay the shaving until after the ghusl if he is in a state of janābah, so that the ghusl removes its trace from the hair.” And Allah Almighty knows best.

My brother works in a conventional bank and gave me one of the gifts distributed to bank employees — what is the ruling on accepting it?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
There is no objection to accepting such gifts, because the physical gift itself does not carry any inherent prohibition — unlike stolen property. Sin does not transfer or extend to the one who receives the gift, for Allah the Almighty says {what means}: "And no bearer of burdens shall bear the burden of another." [Al-Anʿām/164]
The evidence for this is that the Prophet ﷺ himself ate from the food of the Jews, conducted transactions with them, and purchased from them — and it is well known that their wealth was intermingled with ribā. Similarly, the wealth of conventional ribā-based banks is a mixture of the lawful and the unlawful.
Ibn Ḥajar al-Haytamī, may Allah have mercy upon him, states: "It is not forbidden to transact with one whose wealth is predominantly unlawful, nor to eat from it — as al-Nawawī affirmed in al-Majmūʿ." [Tuḥfat al-Muḥtāj, Vol. 9/P.389] And Allah the Almighty knows best.

What is the ruling on the fasting of a woman who has reached menopause if menstrual blood flows?

If a woman reaches the age of menopause (which is usually sixty-two) and her menses have ceased, then she sees blood after that, and its duration is not less than a day and a night (24 hours), it is menstruation (hayd). If it is less than a day and a night, she is considered as having non-menstrual vaginal bleeding (mustahada), so she fasts and prays. However, she must perform ablution for every obligatory prayer after its time enters, pray immediately, and be treated as a person with a continuous condition. There is no specific end limit for a woman's menstruation; it is possible as long as the woman is alive. And Allah the Almighty knows best.
