Islam Prohibits Violence and Transgression

One of the objectives of Sharia for which the Master of mankind, Prophet Mohammad (PBUH), was sent and without which societies and civilizations would go astray is spreading love and mercy among people as well as combating all forms of transgression and vandalism from which Islam is innocent. These cowardly acts tarnish the beautiful image of Islam, twist its objectives and tie violence and vandalism to its compassionate principles.

Pondering upon the evidences from the Quran and the Prophetic Sunnah shows the magnitude of the texts that indicate that a human being is honored, forbidden to oppress or violate his faith, life, honor and wealth. Almighty Allah Says {What means}: "We have honored the sons of Adam; provided them with transport on land and sea; given them for sustenance things good and pure; and conferred on them special favours, above a great part of our creation." {Al-Isra`/70}.

According to Islam, it is unlawful to frighten a Muslim and spread discord amongst members of society. Narrated Abdur Rahman Ibn Abu Layla:

The Companions of the Prophet (PBUH) told us that they were travelling with the Prophet (PBUH). A man of them slept, and one of them went to the rope, which he had with him. He took it, by which he was frightened. The Prophet (PBUH) said: It is not lawful for a Muslim that he frightens a Muslim." {Abu Dawud}. Abu Huraira reported: Abu'l-Qasim (the kunya of Allah's Messenger, may peace be upon him), said: He who pointed a weapon towards his brother the angels invoke curse upon him even if he is his real brother so long as he does not abandon it (the pointing of weapon towards one's brother Muslim)." {Muslim}. Narrated `Abdullah:

The Prophet (PBUH) said: "Abusing a Muslim is Fusuq (evil doing) and killing him is Kufr (disbelief)." {Bukhari}.

The duty of advising others dictates that we raise the awareness of Muslims everywhere and explain to them the dangers and repercussions of violence in the sense that it breeds hatred and enmity amongst the members of society, sows the seeds of sin and transgression, and prevents achieving security and safety for humanity. Allah The Almighty Says {What means}: "Help ye one another in righteousness and piety, but help ye not one another in sin and rancor: fear Allah. for Allah is strict in punishment." {Al-Ma`idah/2}.

We affirm that violence occurring at the family, university or community levels is an intrusion on our Jordanian Muslim society and Arab-Islamic culture and values stemming from authenticity, compassion and mercy. The only fruit for this violence is damaging and corrupting public and private property, thereby causing harm to citizens and their interests. This is mischief in the land and Allah doesn`t love those who do mischief. He, The Almighty Says {What means}: "But seek, with the (wealth) which God has bestowed on thee, the Home of the Hereafter, nor forget thy portion in this world: but do thou good, as God has been good to thee, and seek not (occasions for) mischief in the land: for God loves not those who do mischief." {Al-Qasas/77}. If Allah The Exalted Forbade transgressing against the property of others and prescribed penalties for that in this life and the next, He also Forbade violating properties and public funds, which belong to all members of society, and considered this as an unjust act for society and self since Allah Loves not the unjust.

In this regard, there is a Sharia maxim that states: "There should be neither harm nor reciprocating harm." What is the use behind killing, beating or abusing someone? What is the use behind destroying property and disrupting schooling other than spreading evil and corruption in the land? The escalation of violence leads to increasing human and material losses. This is destroying the crops and the cattle and a sinful transgression against the right of society, and the doer of this along with whoever assisted him/her will be held accountable for that on the Day of Resurrection.

Undoubtedly, acts of violence increase tribal dissension about which the Prophet (PBUH) said: "Leave it. For it is something disgusting."{Bukhari}.

We all know that violence spreads discord and boosts rumors, thereby spreading fear, terror and dismay among people leading to the elimination of security, peace and stability. This is in addition to extinguishing the flame of knowledge that our universities, institutions and families spread; consequently, losing our leading role, which Allah Praised us for when He Said (What means): "Ye are the best of peoples, evolved for mankind, enjoining what is right, forbidding what is wrong, and believing in God. If only the People of the Book had faith, it were best for them: among them are some who have faith, but most of them are perverted transgressors." {Al-Imran/110}. "

This is a call for our blessed society to resort to reason in all its affairs and adhere to the guidance of Islam concerning kindness, mercy and tolerance. It is also a call for all researchers, scholars and preachers to work on remedying this extraneous phenomenon to spread the culture of compassion and tolerance and eliminate all forms of violence.

Oh Allah! Bless this country and the other Muslim countries with safety and security. And all perfect praise be to Allah The Lord of The Worlds.

Summarized Fatawaa

Is it permissible to purchase the Udhiyah on installments?

It is permissible to purchase the sacrificial animal (uḍḥiyyah) on installments or by borrowing its price. However, it is not recommended for the poor to do so, because they are not required to offer a sacrifice, and Allah does not burden a soul beyond its capacity. If doing so would lead to negligence in providing for one's dependents (nafaqah wājibah), then giving precedence to obligatory maintenance over borrowing to buy the sacrifice is appropriate. This is based on the saying of the Prophet (peace and blessings be upon him): "It is sufficient sin for a person to withhold food from those whom he is responsible to support."

Furthermore, the sacrifice is valid from one who has a debt, but it is preferable (awlā) to repay the debt first, especially if the debt is due immediately (ḥāll). And Allah Almighty knows best.

What is the ruling on a suitor (khāṭib) going out alone with his fiancée before the marriage contract is concluded?

It is unlawful for a suitor, prior to the marriage contract , to do anything that would be unlawful for any non-maḥram man — including touching his fiancée, being secluded with her (khalwah), or seeing her without her complete sharī‘ah-compliant covering — even after the recitation of al-Fātiḥah (This is a cultural custom to seek Allah's blessing (barakah) and mark mutual consent) and the family's approval [of the engagement]. This is because the engagement, without the formal marriage contract, does not render unlawful matters permissible. And Allah, the Exalted, knows best.

What is the ruling on using the *subḥah* (prayer beads) to count during *tasbīḥ* and *dhikr*?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is recommended to use the ordinary or electronic subḥah (prayer beads or counter) to count tasbīḥ, dhikr, and istighfār, because it helps one to remember Allah. Many reports have been transmitted from the Companions and the Followers (tābiʿūn) showing that they continued to use strings of date pits as an aid to dhikr and tasbīḥ.
It is one of the lawful means of worship. Indeed, what is established from the Prophet (peace and blessings be upon him), namely that he counted tasbīḥ on his right hand, shows that it is permissible to count tasbīḥ with whatever helps a Muslim keep track of the number. There is therefore no basis for calling it an innovation (bidʿah), and we know of no jurist who said so.
Al-Ḥāfiẓ al-Suyūṭī (may Allah have mercy on him) wrote a dedicated treatise on the subject titled al-Minḥah fī al-Subḥah, printed within al-Ḥāwī li’l-Fatāwī (vol. 4–6).
Shaykh al-Islām Imam Ibn Ḥajar al-Haytamī (may Allah have mercy on him) was asked: Does the subḥah have a basis in the Sunnah? He replied: “Yes, and al-Ḥāfiẓ al-Suyūṭī wrote on this. Among the evidence is what is authentically reported from Ibn ʿUmar (may Allah be pleased with them both): ‘I saw the Prophet (peace and blessings be upon him) counting tasbīḥ on his hand.’ Ibn Abī Shaybah, Abū Dāwūd, and al-Tirmidhī also narrated: ‘Hold fast to tasbīḥ, tahlīl, and taqdīs, and do not be heedless, lest you forget the affirmation of Allah’s oneness (tawḥīd). Count them on the fingertips, for they will be questioned and made to speak.’ Counting tasbīḥ with pebbles, date pits, and a knotted string has also been reported from a group of the Companions and those after them. Some scholars held that counting on the fingertips is better than the subḥah, based on the ḥadīth of Ibn ʿUmar. Others distinguished, saying: if the one reciting is safe from miscounting, counting on the fingertips is better; otherwise the subḥah is better.” [al-Fatāwā al-Fiqhiyyah al-Kubrā, Vol.1/p.152]. And Allah Almighty knows best.

A man led the people in prayer as imam, and at the end of the prayer he performed a prostration of forgetfulness (*sujūd al-sahw*) because he had omitted a short *sūrah* after al-Fātiḥah. What is the ruling on his prayer and that of those praying behind him?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
According to the Shāfiʿī school, it is sunnah to recite a sūrah after al-Fātiḥah in the prayer. One who omits it has a valid prayer, and no prostration of forgetfulness (sujūd al-sahw) is prescribed for omitting it. If someone performs sujūd al-sahw for its omission while knowing the ruling and remembering it, his prayer is invalidated. But one who is ignorant of the ruling, or who did so out of forgetfulness, his prayer is not invalidated, because this is among the matters that are obscure to people, and ignorance of it is not restricted to those who recently entered Islam.
Shaykh al-Islām al-Shams al-Ramlī said in Nihāyat al-Muḥtāj ilā Sharḥ al-Minhāj (Vol.2/p.70): “The remaining sunnahs are not compensated for by prostration, such as the remembrances (adhkār) of bowing and prostration, that is, the opening supplication (duʿāʾ al-iftitāḥ) and the sūrah, in accordance with the base rule, because they are not of the same nature as what has been reported [as compensable]. If one prostrates for any of them deliberately, his prayer is invalidated, unless he is excused due to ignorance. As for the objection raised that the ignorant person does not know that sujūd al-sahw is prescribed, and whoever knows it knows its place, this is refuted by denying such a necessary connection, for the ignorant person may hear only that sujūd al-sahw is prescribed before the salām, and so assume that it applies to every sunnah and is not restricted to its prescribed place.”
This is among the matters that are obscure, in which the mukallaf is excused for ignorance, as stated by al-Shabrāmallisī in his Ḥāshiyah ʿalā Nihāyat al-Muḥtāj (Vol.2/p.70).
However, if the imam prostrates, and the follower (maʾmūm) presumes that his imam’s prostration is for a reason for which one does not prostrate, it is not permissible to follow him in it, so long as the follower knows the ruling.
Accordingly, the prayer of one who did not recite a sūrah after al-Fātiḥah is valid, and sujūd al-sahw is not prescribed for it. Whoever prostrates out of ignorance or forgetfulness, his prayer is valid, because this is among the issues hidden from the general public. But whoever prostrates while knowing the ruling and remembering it, his prayer is invalidated. And Allah Almighty knows best.
