Statement on Fatwa and Credibility in its Dissemination

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

The Iftaa` Department continues its sacred role in issuing Fatwas as part of its religious and national responsibility, and emanating from the words of Allah The Almighty Who Says (What means): "And before thee also the apostles We sent were but men, to whom We granted inspiration: if ye realise this not, ask of those who possess the Message." [An-Nahil/43].

These Fatwas cover a wide spectrum, such as acts of worship, transactions, philosophy, and morals. The Department stresses that its message aims to establish the foundations of the making of Fatwa in an institutionalized and global form. This is based on the magnanimous objectives of Sharia and the concepts of the true Islam in a bid to raise the religious awareness of society, preserve its intellectual security and social unity, and fortify it against aberrant and extreme thoughts.

It is well known that a Fatwa has special context and circumstances and is usually issued as an answer to a questioner who wants to know the ruling of Sharia on a certain issue. Some Fatwas are published on the Department`s website not for propaganda but to be benefitted from by researchers, academicians, and students of knowledge.

It has been observed that media publish some Fatwas out of their true frame and circumstances causing them to be misunderstood and reflecting a negative image of the nature of the Department`s work.

In addition to stressing the pioneering role of the media in transmitting the information, the Department reminds that it isn`t permissible to take the Fatwa out of its occasion, time, place or use it for a purpose other than that for which it was issued in the first place. Therefore, the Department calls on media to spread Fatwas based on the moral responsibility governing the staff working in this field. This is to serve the country and citizens as well as preserve its safety and security. And All perfect praise be to Allah The Lord of The Worlds.

Summarized Fatawaa

What is the Islamic ruling on one who was unable to fast and then regained the ability?

He is not required to make up the fast (Qada) even if he becomes capable of it; whether he regained the ability to fast after paying the fidya (feeding a needy person for each day of missed fasting) or before it, because he was liable for paying it in the first place, so it remains binding upon him. However, if he delayed paying it beyond the first year, nothing is required of him due to the delay. If he is unable to pay it, it does not remain as a debt upon him. And Allah the Exalted knows best.

Does an internal medical examination for a woman affect her fast?

An internal medical examination for a woman invalidates the fast because it involves the entry of a foreign object into the body cavity (jauf) while fasting.
In this case, the woman must refrain from eating and drinking for the rest of the day out of respect for Ramadan and make up for the missed fast after Ramadan.
Such an examination should be avoided in Ramadan and other months unless absolutely necessary, as exposing the private parts is only permissible in cases of necessity.
If necessary, a woman should seek a Muslim female doctor first. If one is unavailable, she may see a female doctor from the People of the Book (Jews and Christians). If neither is available, she may consult a trustworthy and competent Muslim male doctor.

What is the meaning of the word aqiqah?

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
The 'aqīqah in its linguistic sense refers to the hair upon the head of a newborn at the time of birth.
In its Sharī'ah sense, it refers to the livestock that is slaughtered on behalf of a newborn child.
And Allah Almighty knows best.

I own a pharmacy and have only merchandise. A full year (*ḥawl*) has passed and I have no cash. How do I pay the zakāh?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
Zakāh must be paid immediately from the day it becomes due, and delaying it is forbidden when one is able to pay it, because it is the right of the poor, and it is forbidden to delay giving people their rights except for a valid Sharīʿah excuse. Shaykh al-Islām Imam al-Nawawī (may Allah have mercy on him) said: “In our school, zakāh must be paid out immediately. Once it becomes due and he is able to pay it, it is not permissible to delay it. If he is unable, he may delay it until he is able. If he delays it after being able, he is disobedient and becomes liable for it.” [al-Majmūʿ Sharḥ al-Muhadhdhab, Vol.5/p.333]
If cash is not available to pay the zakāh and the only option is to pay in installments, he must pay it, even if in installments, from the proceeds of the merchandise that is sold after the time the zakāh became due, by deducting a set amount from each day’s takings. And Allah Almighty knows best.
