In the Name of Allah, the Entirely Merciful, the Especially Merciful

Statement on the so-Called "Deal of the Century"

All perfect praise be to Allah the Lord of the Worlds. May His blessings and peace be upon Prophet Mohammad, all his kin and companions.

The General Iftaa` Department censures and rejects the so-called "Deal of the Century" and affirms that Jerusalem is the capital of Palestine and that the Hashemite custodianship over it is amongst the non-negotiable, religious and national principles. It also affirms the right of the Palestinians to live on their national territory and that none has the right to surrender a bit of sand from the land of Palestine. Jordan will continue to defend Jerusalem, its holy sites and the blessed land of Palestine, and this is the position of all Jordanians led by His Majesty King Abdullah II. Allah Says (What means): "And God hath full power and control over His affairs; but most among mankind know it not." [Yousef/21].

Summarized Fatawaa

What is the ruling on someone who fasts but does not pray?

A Muslim must be diligent in fulfilling all obligations, and after the Shahadah, prayer is the most important duty.
● If someone abandons prayer out of disregard, they are considered a disbeliever, and their fasting is not accepted.
● If they abandon prayer out of laziness, they are still a Muslim, and their fasting remains valid, but they have committed a grave sin by neglecting prayer.

What is the ruling on the ablution of one who touches women prohibited to him by a temporary prohibition (mahram bi-hurma mu'aqqata)?

It is prohibited to touch a woman who is temporarily prohibited (meaning one whom it becomes permissible to marry after the impediment is removed, such as the wife of a brother or paternal uncle). Touching her without a barrier invalidates ablution. And Allah the Almighty knows best.

Is the marriage, which lacks a valid legal contract, a guardian, and a court registration, valid?

It is incumbent that a valid marriage contract be concluded in the presence of a guardian and two trustful witnesses, and it should be registered in the court to protect the rights of the wife. Actually, a valid marriage contract is what differentiates between sound marriage and fornication.

For some time I have been searching for a guiding shaykh to teach me the spiritual path (*sulūk*) and the Islamic sciences, but I have not found one. What should I do?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
There is abundant good in this Ummah, and the scholars who guide and nurture are never cut off. The student of knowledge should strive in seeking them out, ask diligently after them, and draw from their learning.
As for one who cannot find a guiding and nurturing shaykh, he should send abundant prayers and peace upon our master the Prophet (peace and blessings be upon him), while keeping constantly to dhikr and worship and abstaining from the forbidden. For that will bring him to his goal in traveling toward Allah the Exalted. Imam Muḥammad al-Sanūsī (may Allah have mercy on him) said: “I have seen it said by some of the imams of Sufism that whoever lacks shaykhs of spiritual training (shuyūkh al-tarbiyah) should increase his invocation of blessings upon the Prophet (peace and blessings be upon him), for by it he will reach his goal.”
The scholar Aḥmad Zarrūq al-Mālikī (may Allah have mercy on him) said in Qawāʿid al-Taṣawwuf (p. 86), rule no. 114: “Dhikr is the decree of sainthood (manshūr al-wilāyah). Whoever is given dhikr has been given the decree. Our shaykh Abū al-ʿAbbās al-Ḥaḍramī (may Allah be pleased with him) said: ‘Keep constantly to dhikr and abundant blessings upon the Messenger of Allah (peace and blessings be upon him), for it is a ladder, an ascent, and a path to Allah the Exalted when the seeker does not meet a guiding shaykh.’” And Allah Almighty knows best.
