Subject : It isn`t Permissible to Abort Pregnancy Resulting from Unregistered Marriage

Question :

After getting a final divorce, I married another man, but didn`t register that marriage in Islamic court, nor told my father about it. Now, I`m forty days pregnant. Is it permissible for me to abort this fetus because my husband doesn`t want it?



The Answer :

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon Prophet Mohammad and upon all his family and companions.

 

It isn`t permissible to abort a fetus except when it jeopardizes the mother`s life and in case of special medical condition. Based on the above question, medically speaking, the mother`s life isn`t in danger. Therefore, it isn`t permissible to abort this fetus and We (Iftaa` Department) advise the asker to register her marriage in Islamic court after getting the approval of her guardian to preserve her rights and those of her fetus's. And Allah The Almighty Knows Best.
