Resolution No.(158) (24/2010) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling when the Deceased`s Heirs Take his Life Insurance Money"

Date: 17/1/1432 AH, corresponding to 23/12/2010 AD.

 

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its twelfth session held on the above date, the Board reviewed the following question:

Is it permissible for the heirs to take the life insurance money of their deceased father or not? 

After prolonged deliberations, the Board decided what follows:

If the company for which the deceased used to work made that insurance for him and paid its installments, then it is permissible for his heirs to take whatever amount they can from the insurance company.

However, if the deceased himself made that insurance of his own accord and paid its installments, then it is permissible for his heirs to take the amount of these installments and to give the rest in charity to be Rewarded from Allah, because that money is ill-gotten. And Allah Knows Best.

Note: If it was a cooperative Islamic insurance company that adheres to the rules of Islamic Sharia, then it is permissible to deal with it as indicated in Fatwa No.(2994).

I took a car from the Orphans' Fund Development Institution; is there usury (Riba) involved in this transaction?

If the Sharia's conditions were met, then there is no harm in this. And Allah The Exalted Knows Best.

My maternal aunt`s son is living abroad; however, both our families have recited Al-Fatehah declaring our engagement. Betrothal is a promise to marry, so your betrothed is a stranger to you and isn`t permitted to look at you even through a picture. Once your marriage contract is concluded, you become husband and wife and he can look at you as much as he wants. Moreover, he may deputize his father to carry out the procedures of the marriage on his behalf. And Allah The Almighty Knows Best.

What should one who made an intention, at night, to make up for a missed fasting day, but broke his fast on the next day?

One who started making up a missed fasting day, then broke his/her fast without a legitimate reason is considered sinful, and is only obliged to make up for the missed fasting days. And Allah Knows Best.

What is the ruling of Sharia on marrying a Jewish woman, dealing with the Jews, and going to Israel?

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
It is allowed for a Muslim to marry a Jewish or a Christian woman provided that this doesn`t affect his religion. As for dealing with the Jews who are outside Palestine, it is the same as dealing with the Christians; it is permissible as long as it doesn`t harm Islam. As for dealing with the Jews who are inside Palestine, the ruling differs depending on the persons themselves and the situations. By the end of the day, a believer`s heart leads him/her to what is good. And Allah The Almighty Knows Best.
