Resolution No. (266) (20/2018) by the Board of Iftaa`, Research and Islamic Studies: "Ruling on Renting Mosque`s Roof"

All perfect praise be to Allah The Lord of the Worlds and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

On its fourteenth session held on the above date, the Board reviewed the letter of His Excellency Minister of Awqaf Islamic Affairs and Holy Places (No.3/2/346-5/11/2018). It read as follows: I would like to bring to Your Grace`s attention the fact that the Awqaf Council has reviewed the request submitted for investing the roof and yards of Huthayfah Ibn Al-Yaman`s Mosque (Tabaraboor). Ad-Dar Darak Restaurant will install a solar system there for a period of twenty-five years in return for an annual payment. However, the Ministry of Awqaf will be the sole owner of that system and it won`t affect the mosque`s solar panels. Could you clarify the ruling of Sharia on this so that the Awqaf Council takes the proper decision in light of it? 

After deliberating, the Iftaa` Board arrived at the following resolution:

There is no harm in renting the roof of that mosque for installing solar power generators where the rent money is steered to the benefit of the mosque. This is provided that this project doesn`t prevent people from performing prayers since Sharia neither hinders a well-established interest nor whatever helps visit and maintain the mosques of Allah. The important thing, here, is that the Waqf (Endowment) maintains serving the purpose for which it was endowed in the first place and that no harm is inflicted upon the praying people and other worshippers. The proof of this is that it was reported that some Hanafi jurisprudents said, "It is allowed to rent the roof of a mosque to use the rent money for its maintenance."{Al-Bahar Al-Raa`iq}.

Is performing Umrah an obligation for who is capable. Is he accountable for not performing it in this case?

Umrah is an obligation once in a lifetime for every Muslim. When physical and financial ability is present, it is preferable to perform Umrah, as well as Hajj. If one can afford to perform Umrah but not Hajj, then they should begin with Umrah, especially since Hajj nowadays is not accessible to everyone who wishes to perform it. In contrast, Umrah is more open and easier to undertake. And Allah knows best.
 
 
 
 
 

My mother inherited a share from my late father`s and brother`s property; however, the inheritance, a piece of land, wasn`t divided amongst the eligible heirs because it was hard to sell. While alive, she used say that she wanted these shares to be distributed amongst the poor and needy. What is the ruling of Sharia on this?

All perfect praise be to Allah, the Lord of the worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions.
This is a will, so we have to consider the estate she had left behind. If the piece of land, which she had willed, equals one third and less of her estate, then the will must be executed. But, if it is more than one third, then one third must be executed and the rest of the estate, if the heirs agreed, is to be executed  as part of her will as well. However, if the heirs haven`t approved of that, then what remains, excluding that one third, must be divided amongst them according to the Islamic rules of inheritance. Moreover, we recommend that you pay a visit to the Iftaa` Department to make things clearer for you. And Allah The Almighty Knows Best.

It was found out that a man divorced his wife for the third time in 2005, but they continued cohabiting as man and wife. However, when they realized that what they were doing was unlawful, they came the Iftaa` Department in 2009 and were told that they can`t be together. What is the position of Sharia on this couple?

Her Iddah* period starts after the third divorce. As for the continued cohabitation, it is unlawful because being ignorant about the rulings of Sharia while in Dar Al-Islam* is no valid excuse. If a baby came as the fruit of this unlawful consummation of marriage, then a judge of Sharia has the final say in this regard because lineage is a serious matter. And Allah The Almighty Knows Best.
* ʿIddah: a specified period of time that must elapse before a Muslim widow or divorcee may legitimately remarry. The Qurʾān (Sura,2/verse,228) prescribes that a menstruating woman have three monthly periods before contracting a new marriage; the required delay for a nonmenstruating woman is three lunar months.
* Dar Al-Islam: designates a territory where Muslims are free to practice their religion, though this often implies the implementation of Islamic law, whereas Dar al-Harb represents those lands ruled by non-believers

I missed fasting 30 days of the obligatory fast within the last 6 years and 20 days. How do I fast? And what should I do? 

Missed fasting days must be made up, and it is permissible to make them up on non-consecutive days, as continuity is not required for making up missed fasts. Additionally, expiation (Fidya) must be given: feeding one needy person for each day if the makeup is delayed for one year. If the delay extends to two years, Fidya must be given to two needy people per day, and so on. And Allah Knows Best.
