Resolution No.(67): "Ruling on Dividing Land in Accordance with Tameem Ad-Dari`s Endowment"

Date: 23/5/1424 AH corresponding to 23/7/2003 AD.

 

The Board received the following question:

How to divide an inherited plot of land {Waqf Tameem Ad-Dari type} amongst eligible heirs, taking into consideration that it is located within the borders of Al-Khalil Municipality. Is it possible to divide it according to Sharia, or the Ottoman Land Code?

Answer: All success is due to Allah.

After deliberation, the Board is of the view that the revenue of the aforementioned plot and the structure on it is to be divided according to Sharia, and not the Ottoman Land Code. This is because it isn`t a miri land stated in the Ottoman Land Code, rather, it is registered as an endowment of Tameem Ad-Dari`s type, located within the borders of Al-Khalil Municipality.  have an amount of 2,700 Jordanian dinars, which I have invested in a project, and I pay zakat on it every year. However, I have debts and obligations, and this project yields only a profit of about 2-4%. My salary is not enough to support myself and my family to the extent that I cannot pay the electricity bills. Is it permissible for me to take from the above Zakat?
 

You permitted to take from your Zakat since your income insufficient for you, because the poor is permitted to take from the Zakat in general, besides; the poor is identified of whose income doesn't suffice him. And Allah Knows Best.

What is the ruling on buying a car from someone for less than the market price, because they are in a hurry to travel and want to sell their belongings at a lower price due to their urgency?

Yes it is permissible; however, a Muslim shouldn't take advantage of other's difficult situations.

What is the Islamic ruling on parents asking son to divorce his wife?

Praise be to Allah the Lord of the Worlds.

If their asking him to do so is justified in Sharia, then there is no blame on him to obey them. And Allah The Almighty Knows Best.

Is it allowed for a Muslim woman to wear nail polish?

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
Nail polish is an adornment that a woman is allowed to wear for her husband, and not in the presence of non-Mahram men. However, during ablution water needs to reach the nails, so it isn`t possible to perform 'Wudu (ablution) with nail polish on. Therefore, it isn`t valid to make Ghusl Jnabah (Ghusl performed after sexual intercourse or ejaculation), Ghusl after menstruation and Ghusl after Nifas (blood of childbirth) while wearing nail polish. And Allah The Almighty Knows Best.
