Resolution No.(306), By The Board of Iftaa', Researches and Islamic Studies:

"Ruling on Health Insurance"

Date: (25th of Jumada Al Oula, 1443 AH), corresponding to (30/12/2021 AD).

 

In the name of Allah, Most Gracious, Most Merciful

All perfect praise be to Allah, the Lord of the Worlds; may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

On its sixteenth meeting held on the above date, the Board of Iftaa`, Research, and Islamic Studies reviewed question No.(207233) sent to the electronic website of The General Iftaa` Department. It stated as follows: I work for a company of the private sector and we have optional health insurance. What is the ruling of Sharia on this health insurance taking into consideration that the company where I work deals with a conventional insurance company where an amount of 11JDs is deducted from an employee`s salary while the rest is covered by the employer?

After careful consideration, the Board decided what follows:

Health treatment is one of the necessities emphasized by the Maqasid of Sharia (Higher objectives of Sharia). Due to the progress accomplished in the field of medicine and the diversity of its techniques, meeting this need has become too expensive, so individuals couldn`t afford treatment and this negatively affected their health.

Since public need is ranked as a private necessity and the rules of Sharia rests on warding off harm and hardship, then it is permissible for an employee to have access to the services of medical insurance by virtue of his/her company having concluded a contract to that end with an insurance company. It is also permissible for an employee to include his/her dependents in those services as well. However, we advise employers to insure their employees with cooperative insurance companies that observe the standards of Sharia in this regard. And Allah The  Almighty Knows Best.

When Iddah is Initiated for Deceased's Wife?

All perfect praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions.

Iddah is observed on the same date at which her husband passed away for four months, but as for the pregnant, it is observed at the date she gives birth. And Allah Knows Best. 

What is the ruling of Sharia on unregistered marriage in Jordan?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
Aishah narrated that the Messenger of Allah said: "Whichever woman married without the permission of her Wali her marriage is invalid, her marriage is invalid, her marriage is invalid. If he entered into her, then the Mahr is for her in lieu of what he enjoyed from her private part. If they disagree, then the Sultan is the Wali for one who has no Wali." [At-Tirmithi, Hadith No.1102]. The Prophet (PBUH) also said: "There is no marriage without a guardian and two honorable witnesses." Related in [Al-Mo`jam Al-Basit for At-Tabarani, pp.6366]. Registration of the marriage contract at Islamic court is necessary for the preservation of rights and failing to do so is punishable by Jordanian Law. And Allah The Almighty Knows Best

What is the ruling on paying a sum of money to Saudi citizen in return of having Saudi residence? It is worth noting that this transation is labelled as a "worker's visa" but I am not going to work as such only to facilitate having it?

Allah The Almighty Says (What means): "O you who have believed, fear Allah and be with the truthful" [At-Tawbah/119]. False statements contradict truthfulness, and it is not permissible to write them. A Muslim has the right to live in any Islamic country, and those who prevent him will be accountable before Allah about their action and the justification for the prohibition. And Allah Knows Best.

Is it permissible for my brother, whom I had suckled, to conclude a marriage contract between his daughter and my son?

Such marriage is impermissible since one`s nephew in this situation is considered an uncle to one`s daughter; consequently, he is the brother of her father by suckling. In such cases, the people in question should go to court to prove the suckling.
