Resolution No. (305) "Pertaining to the Beneficiary from the Compensation Payment out of Solidarity Fund"

Resolution No.(305) (10/2021), By The Board of Iftaa', Researches and Islamic Studies:

"Pertaining to the Beneficiary from Compensation Payment out of Solidarity Fund"

Date: (22/Shawal/1442AH), corresponding to (3/6/2021AD).

In its 8th meeting held on the above date, the Board of Iftaa` reviewed the letter No.(2560/2021) sent on (10/3/2021) from the Head of Jordanian Construction Contractors - Eng.Ahmad Yaqoob, it reads as follows:

It is incumbent upon a subscriber according to the regulations of social solidarity fund, to identify the beneficiary to receive the compensation payment in case of the former's death, as is the case with: "Mr. M.L, who is a subscriber in our fund whereas his son R.L was identified as the beneficiary entitled to receive the payment; unfortunately, the latter passed away, and after a short period of time and before updating the name of the new beneficiary, the father passed away as well on 27/10/2020. What is the ruling regarding the one who is entitled to receive the above payment  in this case?

After prolonged deliberations, the board decided what follows:

In principle, it is obligatory to abide by what was stated by the subscriber in the application side by side with the regulations of social solidarity fund system of Jordanian Construction Contractors; yet, due to the death of the beneficiary as mentioned above, dividing it among the heirs of the subscriber is an obligation in accordance to their shares as stipulated by the courts of Sharia. And Allah Knows Best.

Summarized Fatawaa

Is it enough to say Tasbeeh (Saying Subhaana Rabbiya Al-‘Atheem during Rukoo`, and saying Subhaana Rabbiya Al-A‘laa during Sujood ) once, or twice during Rukoo`(Bowing in prayer) and Sujood (Prostration)?

All perfect praise be to Allah, The Lord of The Worlds                                                                                                                                                                  Yes, saying Tasbeeh once during Rukoo` and Sujood is enough, provided that the worshiper`s attentiveness of the heart isn`t undermined during each. As regards the recompense, it depends on the number of Tasbeeh. And Allah Knows Best.

What is the ruling on a person in a state of major impurity (junub) or a menstruating woman (ha'id) reciting the Quran from memory?

It is not permissible for a menstruating woman, a postpartum woman, or a person in a state of major impurity to recite anything from the Quran, whether from memory, from the Quran, from a phone, or a computer. It is also not permissible for them to touch the Quran, based on what was reported from Ali bin Abi Talib that the Prophet (peace be upon him) was not prevented from anything regarding the Quran except major impurity (janabah). (Reported by al-Tirmidhi who said it is a hasan sahih hadith). Menstruation and postpartum bleeding are analogous to major impurity (janabah) as they are all major impurities (hadath akbar).
For those mentioned, it is permissible to mention Allah and supplicate even with verses from the Quran, provided they do not intend them as recitation of the Quran, but intend them as remembrance (dhikr) or supplication (du'a). And Allah the Almighty knows best.

Does vomiting during the day in Ramadan break the fast?

Intentional vomiting is one of the nullifiers of fasting; whoever vomits deliberately breaks their fast.
However, if vomiting occurs involuntarily, the fast remains valid as long as nothing returns to the body cavity (jauf). If anything is swallowed back, the fast is invalidated.
The Prophet ﷺ said: "Whoever is overcome by vomiting does not have to make up the fast, but whoever induces vomiting deliberately must make it up." [Narrated by Abu Dawood and At-Tirmidhi]

What is the ruling on using an inhaler while fasting?

Using an inhaler through the nose or mouth breaks the fast because the medication in these inhalers is intended to reach the lungs, which are considered part of the body cavity (jauf).
● If a person needs to use it occasionally, they may use it while fasting, continue refraining from food and drink for the rest of the day, and make up for the missed fast later.
● If a person needs to use it daily, they may use it while fasting, continue refraining from food and drink, and pay fidyah (feeding one needy person per missed day).
