About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. Wearing colored lenses for treatment is permissible, and wearing them as an adornment is also permissible, provided that she isn`t seen while having them on by non-Mahrams (Marriageable men). And Alalh Knows Best.

What is the ruling of Sharia on marrying the maternal niece of one`s wife?

One may not combine in marriage a woman and her paternal aunt, or a woman and her maternal aunt, as stated the Prophet (Peace and blessings be upon him). And Allah The Almighty Knows Best.

An Arab young man had an illegitimate sexual relationship with a Christian American while she was staying in one of the Arab countries. After she returned to America, she told him that she had doubts that she was impregnated by him. It is worth pointing that it is hard for him to get a visa to the USA. What is the ruling of Sharia on this?

Zina (Adultery and extramarital relations) is one of the grave sins that incur the wrath of Allah if the adulterer didn`t make immediate repentance. However, the child isn`t attributed to the adulterer. Rather, he/she is attributed to the woman who got pregnant by him and, according to Sharia, it isn`t considered a legitimate child of the adulterer. And Allah The Almighty Knows Best.

What is the ruling on performing Umrah after the latest expansion of the Mas`aa(the passage between As-Safa and Al-Marwah), is it permissible, or not?

Yes, it is permissible to perform Umrah after the latest expansion of the Sa`y area since Sa`y between As-Safa and Al- Marwah is observed.

Is it permissible for a woman who is in her confinement to fast upon seeing blood signs that are neither black, nor red ?

Brownish, reddish, and yellowish discharges are all considered confinement until there is no colored discharge which marks the end of confinement. Moreover, the aforesaid woman is prohibited from fasting until she attains ritual purity.

Who has the right to child custody when final divorce takes place?

The wife has the right to child custody until her children reach the age of puberty. However, if she gets married, the right of custody becomes that of her mother`s.

Is a wife considered divorced if her husband refused to go to bed with her(for sexual intercourse) for two months?

A wife doesn`t get divorced no matter for how long her husband refuses to have sex with her, and she had better go to court.

Is it incumbent on a family to provide for its old handicapped son and take care of him?

The family and relatives- e.g.brothers- of such a person are obliged to spend on him and take care of him if he didn`t have money of his own.
