Resolution No.(59): “Ruling on Planting Trees in Graveyards“

Date: 9/11/1422 AH corresponding to 23/1/2002 AD.

 

Question:

What is the ruling of Islamic Sharia on planting trees in graveyards?

Answer: All success is due to Allah.

According to Islamic Sharia, planting trees in graveyards is permissible since it is included within the general meaning of the Sharia maxim which states that, in principle, things are permissible so long as there is no provision from the Quran and the Sunnah proving otherwise, and there is no evidence that forbids such an act. However, trees shouldn`t be planted directly above the graves, rather, they should be planted in the corridors and places where there are no graves. This is in order for their roots not to harm the dead because doing so is forbidden as stated in the Prophet`s Hadith {what means}: "Breaking a deceased body’s bones is exactly like breaking them when he is alive.” {Related by Abu Dawud in accordance with the conditions of Muslim}. What is the Islamic ruling on adoption, and what is the legal window through which a person can be kind to an orphan girl, attend to her needs and raise her as his own?

Kindness to an orphan entails a great reward from Allah, but adoption is prohibited and invalid. Therefore, it is permissible for the aforementioned person (for example) to make his brother`s wife breastfeed that girl so that he becomes her uncle by suckling provided that he informs her that she isn`t his biological daughter.

What is the ruling of Sharia on woman shaking hands with non-Mahram man?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
The Messenger of Allah (PBUH) said: "It is better to be stabbed in the head than touch a woman to whom one isn`t related." [Transmitted by Al-Tabarani /Al-Mo`jam Al-Kabir, Hadith No.16880]. Accordingly, it is forbidden for men to shake hands with non-Mahram* woman. And Allah The Almighty Knows Best.
 
 
* The women/men that you are allowed to marry. It includes all women/men other than mahram (including cousins).

For passing time, my friends and I have called a famous diviner. She told me that somebody had cast a spill on me not to get married for the rest of my life. I didn`t believe her, but I can`t forget her words. How can I protect myself from such thing?

Dealing with diviners is forbidden and what you are suffering from is due to your having consulted that diviner. Have trust in Allah and ask Him for forgiveness, but rest assured that whatever Allah has decreed will take place. And Allah The Almighty Knows Best.

Is it allowed to shave my beard to join the army taking into consideration that I can`t find a job?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

The army should be joined in preparation for Jihad (Fighting in the cause of Allah), so if Jihad contradicts with growing a beard then it is allowed to shave it. And Allah The Almighty Knows Best.
