Resolution No.(59): “Ruling on Planting Trees in Graveyards“

Date: 9/11/1422 AH corresponding to 23/1/2002 AD.

 

Question:

What is the ruling of Islamic Sharia on planting trees in graveyards?

Answer: All success is due to Allah.

According to Islamic Sharia, planting trees in graveyards is permissible since it is included within the general meaning of the Sharia maxim which states that, in principle, things are permissible so long as there is no provision from the Quran and the Sunnah proving otherwise, and there is no evidence that forbids such an act. However, trees shouldn`t be planted directly above the graves, rather, they should be planted in the corridors and places where there are no graves. This is in order for their roots not to harm the dead because doing so is forbidden as stated in the Prophet`s Hadith {what means}: "Breaking a deceased body’s bones is exactly like breaking them when he is alive.” {Related by Abu Dawud in accordance with the conditions of Muslim}. What is the ruling of Sharia on Zina and what is the punishment for the unmarried man who commits this grave sin?

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
 
The punishment for Zina (Adultery and extramarital relations) is the same for men and women: 100 lashes for the unmarried to be witnessed by a group of the believers. Definitely, this person has incurred the wrath of Allah; however, he must make repentance immediately, refrain from this grave sin, and seek Allah`s forgiveness. And Allah The Almighty Knows Best.

What should a person who doubted having missed a pillar of prayer do?

All praise be to Allah, The Lord of The Worlds.                                                                                                                                                                              The prayer of one who doubts having missed one of its pillars is valid, and nothing is due on him/her since having a doubt after offering the act of worship doesn`t undermine its validity. And Allah Knows Best.

In our region in southern Oman, specifically in the city of Taqah, there is a mosque that they say was built hundreds of years ago. This mosque is surrounded by graves, meaning it is in the middle and the graves are around it. People in our area differ, with some considering it permissible and others considering it forbidden to pray there. Moreover, my grandmother saw in a dream that she entered this mosque..."
 

Praying in this mosque is valid and and there is reprehensibility in its location so long as no grave exist within it. Besides, Sharia rulings aren't derived out of dreams. And Allah Knows Best. 

What is the ruling on paying a sum of money to Saudi citizen in return of having Saudi residence? It is worth noting that this transation is labelled as a "worker's visa" but I am not going to work as such only to facilitate having it?

Allah The Almighty Says (What means): "O you who have believed, fear Allah and be with the truthful" [At-Tawbah/119]. False statements contradict truthfulness, and it is not permissible to write them. A Muslim has the right to live in any Islamic country, and those who prevent him will be accountable before Allah about their action and the justification for the prohibition. And Allah Knows Best.
