Resolution No.(59): “Ruling on Planting Trees in Graveyards“

Date: 9/11/1422 AH corresponding to 23/1/2002 AD.

 

Question:

What is the ruling of Islamic Sharia on planting trees in graveyards?

Answer: All success is due to Allah.

According to Islamic Sharia, planting trees in graveyards is permissible since it is included within the general meaning of the Sharia maxim which states that, in principle, things are permissible so long as there is no provision from the Quran and the Sunnah proving otherwise, and there is no evidence that forbids such an act. However, trees shouldn`t be planted directly above the graves, rather, they should be planted in the corridors and places where there are no graves. This is in order for their roots not to harm the dead because doing so is forbidden as stated in the Prophet`s Hadith {what means}: "Breaking a deceased body’s bones is exactly like breaking them when he is alive.” {Related by Abu Dawud in accordance with the conditions of Muslim}. Islamic creed is a comprehensive creed, and if there is any defect, the creed of the individual or group is not correct. Is the creed of the Sufis correct or not?

Sufism is the practice of applying knowledge; this is how Al-Imam Al-Sha'rani defined it. If some among them have deviations in creed, it is not permissible to generalize this to all Sufis, as there are those among them who are acknowledged by all scholars for their knowledge and virtue. And Allah The Almighty Knows Best.

If a woman makes a vow to slaughter a sheep, and her husband is the one who buys it for her from his own money, and he says: "It is for you until you fulfill your vow with it," Is this permissible, or must she buy it herself from her own money?

If her husband gave her the sheep as a donation for the puprose of fulfilling the oath she made and was slaughtered by the wife or the husband on her behalf then the vow she made is fulfilled. And Allah Knows Best. 

Is the maternal uncle of one`s mother a Maharam?

All perfect praise be to Allah the Lord of The Worlds. May His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.
Mother`s maternal uncle is a mahram. And Allah The Almighty Knows Best.
 
* In Islam, a mahram is a member of one's family with whom marriage would be considered haram, concealment purdah, or concealment of the body with hijab, is not obligatory; and with whom, if he is an adult male, she may be escorted during a journey, although an escort may not be obligatory.

What is the ruling on the existence of cattles' marketplace of (Sheeps, cows and chickens ) inside a graveyard?

Graves must be respected, and it is not permissible to sit on them or show any disrespect. Establishing a marketplace within a cemetery is undoubtedly a form of disrespect to the deceased and is not permissible. Such actions should not be tolerated. And Allah Knows Best.
