Question :

What is the ruling on mocking the Fatwas of Sharia?



The Answer :

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon Prophet Mohammad and upon all his family and companions.

The Fatwa is a clarification of Allah The Most Exalted’s ruling on a real-life issue, or on what is unclear in the rulings of Islamic law. It is a communication on behalf of Allah, the Exalted. That is why scholars have given the Muftis the title of "those who sign on behalf of Allah." Thus, the Fatwa is a rite of the rites of the religion of Islam, indeed, it is one of the greatest rites. Allah, blessed and exalted, attributed it to Himself. He The Almighty Says (What means): "They request from you a [legal] verdict. Say: "Allah gives you a verdict" [An-Nisa/176].

Similarly, it was among the duties of the Messenger of Allah, peace and blessings be upon him. The Companions used to seek his Fatwa in their matters. In the noble Hadith: narrated by Ziyad Bin Abi Sawda, from Maymuna (May Allah Be Pleased with them all), the freed slave of the Prophet, peace and blessings be upon him, she said: "O Messenger of Allah, give us a Fatwa about Jerusalem." He said: "Go to it and pray in it." And the lands at that time were in a state of war. "If you cannot go to it and pray in it, then send oil to be lit in its lamps." [Abu Dawood]. In addition, from Abu Tha'labah (May Allah Be Pleased with him), who said: "O Messenger of Allah, give us a Fatwa about the vessels of the Magians when we are compelled to use them?" He said: "If you are compelled to use them, then wash them with water and cook in them." [Ahmad].

Moreover, from Mu'adh Ibn Jabal (may Allah be pleased with him) said: "I said: O Messenger of Allah, give us a Fatwa/ruling on two drinks that we used to make in Yemen: Al-Bit' which is from honey, fermented until it becomes strong, and Al-Mizr which is from millet and barley, fermented until it becomes strong." He said: "And the Messenger of Allah, peace and blessings be upon him, had been given comprehensive words with concise endings." He said: "I forbid every intoxicant that intoxicates from prayer." [Moslim].

A Muslim must exalt the status of Fatwas, as Allah The Almighty Says (What means): "That [is so]. And whoever honors the symbols of Allah - for indeed, it is from the piety of hearts." [Al-Hajj/32]. Mocking them, belittling them, or hinting at them is, in reality, mocking the ruling of Allah the Almighty, which is forbidden in Islamic law. As for mocking them as a clarification of Islamic law or as containing the verses of Allah The Almighty, it is a cause of destruction that may expose its perpetrator to leaving the fold of Islam - Allah forbid. Allah The Almighty Says (What means): "And do not take the verses of Allah in mockery." [Al-Baqarah/231]. He The Almighty also Says (What means): "And if you ask them, they will surely say: "We were only conversing and playing." Say: "Is it Allah and His verses and His Messenger that you were mocking?" Make no excuse; you have disbelieved after your belief." [At-Tawbah/65-66].

It is forbidden for Fatwas to become a subject of mockery. If there is a dissenting opinion in some Fatwas, it should be presented and discussed with scholars, and the response to it should not be through mockery, of those who issued it, for this is considered belittling of the scholars.

In conclusion, it is forbidden to mock Fatwas and to scoff at them and those who issued them, for they are among the symbols of the Islamic religion that must be exalted. And Allah The Almighty Knows Best.
