The Iftaa` Department Refrains from Interfering in the Judiciary

 

 

Some media reported that the General Iftaa` Department refrained from issuing a Fatwa on the inadmissibility of the testimony of the woman who doesn`t wear Hijab.

 

In response to this claim, the Department wishes to make clear that the requested Fatwa is related to a case pending before the court. Therefore, it refrained from issuing that Fatwa to ensure the impartiality and independence of the judiciary system, the integrity of its provisions and non-interference in its affairs, as provided for in the legislations in force. This is to achieve justice and preserve the rights of the litigants.

 

The Department asserts that non-interference in cases pending before the court is its adopted approach since its establishment to safeguard the integrity of litigation from any external influences.

It is permissible for a mother to give her children from zakat if they are eligible to receive it, even though she is obligated to provide for them. This is based on the saying of the Prophet Muhammad (PBUH) regarding Zainab, the wife of Abdullah Ibn Mas'ud (may Allah be pleased with them): "Your husband and your children are more deserving of your charity" [Al-Bukhari]. All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions  There is no sin in working for the bank that declares compliance with the rulings of Sharia, in addition to adhering to the rulings of the supervising Sharia committee in the bank itself. Each vow has to be fulfilled, and repeating the words of the same vow for confirmation renders its fulfillment obligatory as one vow. As for multiple vows, they have to be fulfilled as well.

Ruling when Husband Utters Divorce Jokingly, or in the State of Intoxication or Anger

The man who utters divorce while in the state of anger, his divorce doesn`t take place and the same ruling applies to the man who is forced to utter divorce because he is threatened to be killed or one of his organs cut off, in addition to other matters that scholars have mentioned in this regard. However, the man who utters divorce jokingly or while having intentionally drunk alcohol, his divorce takes place. And Allah The Almighty Knows Best.
