About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. I married a man and had two children; however, we got separated four years ago. In addition, my husband`s brother, paternal uncle of my children, has been providing for them ever since. In fact, he is an honest, well-behaved man. Is it permissible that we get married although his brother (My ex-husband) is still alive?

All perfect praise be to Allah the Lord of The Worlds. May His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

It is temporarily prohibited for a woman to marry her stepbrother. Therefore, once she receives Talaq Ba`in (Irrevocable divorce), she is allowed to marry her stepbrother, even if his brother (First husband) is still alive. And Allah The Almighty Knows Best.

Is it permissible for a teacher to have one of the school meals originally allocated to students considering that there is plenty of them and they may spoil?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

The Ministry of Education has the final say in this regard because it isn`t allowed to take from public funds save with the permission of the body in charge of spending from it. In fact, we have sent a letter to the Ministry concerning this issue and we are waiting for an answer. However, to prevent spoilage of the meals, they can be sold and the price kept in favor of the students or distributed amongst the students themselves. And Allah The Almighty Knows Best.

Is my husband entitled to take my salary?

Your salary is yours, and you may give some of it to him as a kind of free-will contribution.

What is the ruling on shaving one`s beard?

Growing a beard is mandatory and must be abided by except for a sound reason. And Allah Knows Best.

If someone unknowingly bought stolen cement multiple times, and if the seller is revealed, will my husband bear any sin?

The sin of the theft falls on the one who stole. However, the person who used the cement must pay its value to the rightful owner from whom it was stolen, and then seek reimbursement from the seller. If the thief compensates the rightful owner, there is no liability on the person who used the cement. And Allah Almighty Knows Best.

Is it permissible to swear by (Allah "The Living")?

Yes, it is permissible because "The Living" is one of Allah`s Attributes.

Is it permissible for a man to lie to his wife? Is it permissible for a man to abandon his wife to work in Saudi Arabia, without her approval, although he is wealthy?

The Messenger of Allah commanded men to treat women kindly, so marital problems should be solved through understanding, and whatever causes harm to a woman is forbidden. And Allah The Almighty Knows Best.

What is the Ruling on Reciting the Prophetic Narration?

Reciting the Prophetic narration is permissible as many scholars used to, since in principle, the rulings of recitation have to be observed while speaking Arabic language. And Allah Knows Best.
