About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. I wear braces because I had an accident. However, Iam afraid that I could die and be buried while wearing them because they are permanent installation. Is this forbidden? I also wear false teeth. Should I ask my children to pull them out after I die?

All perfect praise be to Allah the Lord of The Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

If the braces are worn to get teeth back to normal, then there is no sin in that and there is also no harm in wearing false teeth. Moreover, you don`t have to have them removed after your passing away as this undermines the dignity of the dead. And Allah The Almighty Knows Best.

Is it permissible for a woman to conclude her marriage without the approval of her family?

No marriage is permissible without the presence of a guardian and two trust worthy witnesses, and the woman whose family had denied her right in getting married to a God-fearing, financially and physically capable man should go to the court.

Who should pay the Zakah (obligatory charity) from the orphan`s money?

His/her guardian, and if the latter fails to do so, then the orphan himself/herself is obliged to pay the Zakah once he/she reaches puberty, and is capable of handling his/her own affairs. And Allah Knows Best.

Is it true that if a ritually impure, or a menstruating woman visits one who is in confinement, harm will be inflicted on the latter, or her baby?

This is completely wrong and unfounded piece of information.

Had the Prophet (PBUH) been amongst us, Muslims would have supported him, and then he would do whatever pleases the heart of every Muslim. And Allah The Almighty Knows Best.

Is it permissible to listen to chants praising the Prophet if accompanied by musical instruments?

If singing, or chanting in praise of the Prophet was accompanied by a forbidden musical instrument, then it is forbidden.

Is Zakah due on the orphan`s money?

Yes, Zakah is due on the money of the orphan.

What should one who made an intention, at night, to make up for a missed fasting day, but broke his fast on the next day?

One who started making up a missed fasting day, then broke his/her fast without a legitimate reason is considered sinful, and is only obliged to make up for the missed fasting days. And Allah Knows Best.
