About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. 1-A young man whose father and grandfather are dead has died leaving a mother, two sisters and a brother. Do his paternal uncles inherit him?2- A man died leaving daughters, a wife, brothers, a mother or no mother. It is well known that the daughters inherit two thirds and the wife one eighth. To whom does the rest of the estate go and what is the evidence on that from the texts of Sharia?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

1- The full brother or the paternal half-sibling disinherits the paternal uncles. The paternal half-sibling takes one sixth and because they are from the Asabah (Male relatives on the father`s side) of the deceased they take the rest of the estate. The proof of this is that Ibn ‘Abbas (May Allah Be Pleased with them) reported God’s Messenger as saying: "Give the shares to those who are entitled to them, and what remains over goes to the nearest male heir." [Agreed upon]. In this case, nothing is left to them.

2- The brothers take the rest of the deceased`s estate and the full brother disinherits the paternal half-sibling, and the proof of this is the aforementioned narration. And Allah The Almighty Knows Best.

Is it permissible to delay menses by using medication in order to fast Ramadhaan?

It is permissible for a woman to use medication in order to delay her menses so that it becomes lawful for her to fast Ramadhaan, but it is better that she doesn`t do so, and taking the medication is prohibited if she, or her doctors know that it involves a risk on her health.

Is it permissible to listen to chants praising the Prophet if accompanied by musical instruments?

If singing, or chanting in praise of the Prophet was accompanied by a forbidden musical instrument, then it is forbidden.

What is the ruling on working for orphans' institution?

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

There is no sin in working for orphans` institution. And Allah the Almighty knows best.

Statement from the Iftaa` Department regarding Tarawih Prayer

Tarawih Prayer is Twenty Rakhas

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

There are many questions regarding the number of Rakhas in Tarawih prayer.

Tarawih prayer is a Sunnah, and the four Sunni schools of thought are agreed that it is twenty Rakhas. In fact, the Malikis believe that it is thirty-six Rakhas. Based on this, whoever prays eight Rakhas has fulfilled some of this Sunnah, and will be rewarded accordingly. It is well-known that Tarawih prayer is the night prayer in Ramadan {Qiyam}. Abu Hurairah narrated that The Messenger of Allah (PBUH) said: “Whoever prays during the night in Ramadan out of sincere faith and seeking its reward from Allah, will have all of his previous sins forgiven." The Imams of the Sunni schools of thought have conveyed how it is performed starting from the righteous predecessors to the era of the noble companions {May Allah be pleased with them}. In Sunan al-Bayhaqi, from al-Sa'ib ibn Yazid, may Allah be pleased with him, he said: "During the era of Umar ibn al-Khattab, they used to offer twenty Rakhas during Ramadan as Qiyam. He said: They used to recite [the Quran] in groups of two hundred."

This is the practice in the Two Holy Mosques and the ancient Islamic cities. Whoever is able to perform it (Twenty Rakhas) completely has performed the complete Sunnah, and whoever is not able to perform it has performed some of it, and will be rewarded for what he has prayed, but he does not have the right to prevent or prohibit others from completing it. This is because prohibition is only for doing evil while prayer is the best of the deeds of the believers. The Prophet (PBUH) said: (Prayer is the best deed, so whoever can do more, let him do more. Narrated by al-Tabarani, and Allah the Almighty said: (Seest thou one who forbids- A votary when he (turns) to pray?) {Al-Alaq, 9-10}.

May Allah guide us all to His obedience and help us to do so. May Allah bless our Prophet Muhammad and his family and companions.

None of the above materials is forbidden, and it`s lawful to use them in manufacturing products that are beneficial to people. This is because, in principle, all things are lawful so long as there is no evidence in Sharia indicating otherwise. And Allah Knows Best.

Is it permissible for a woman who is observing `Iddah(waiting period) due to the death of her husband to travel for performing Umrah(Minor Hajj)?

A woman observing `Iddah of a revocable(Rajee`) divorce isn`t allowed to travel for Umrah except with the consent of her husband.

What is the ruling on swearing a false oath by the Holy Quran?

Swearing a false oath by the Holy Quran dips the oath-taker in Hellfire, and one who had done so should turn to Allah in repentance, seek His forgiveness, give back rights to whom they belong, and pay the oath expiation.

Should water be put in the deceased`s mouth and nose while washing him/her?

No, it shouldn`t.
