About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. What should a woman, who has given several births during different months of Ramadhaan, and didn`t make up for them in addition to forgetting the exact number of the days and years in which she had missed fasting, do?

She should make up the days of Ramadan that she missed after estimating their number, and paying the ransom (in food) due on each day that she had delayed. She should also repay the ransom according to the number of years if she was able to fast before that time, but didn`t.

Are phone conversations between the two sexes permissible if for consultation, and within the limits of good manners?

Such act is impermissible since it renders hearts corrupt, and could lead to forbidden attachment. Allah, The Almighty, Says (What means): "and follow not the footsteps of the devil." [Al-Baqarah/68].

I have vowed that if Allah gave me what I wanted so bad, I would fast every Monday and Thursday to the rest of my life; unless there is a valid excuse hindering me from doing so. Fortunately, Allah gave me what I wanted, so I started fasting Mondays and Thursdays; however, I stopped out of laziness. What is the Sharia ruling on this?

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

Allah The Almighty described the righteous people of Jannah where He Said (What means): "They perform (their) vows, and they fear a Day whose evil flies far and wide." [Al-Insan/7]. Accordingly, you must do your best to fulfill your vow. However, if you are unable to do so, then feed a poor person for every missed day of fast (About half a JD), and if you are unable to do that, then offer expiation for breaking a vow, which is feeding ten poor Muslims (About half a JD for each), ask Allah for forgiveness and increase remembrance of Him. And Allah The Almighty Knows Best.

Is it permissible for a woman to swear a false oath by the Holy Quran to please her distrustful husband?

It is forbidden for a person to do so since this is considered a false oath(Yamaan Ghamoos) which dips(Yaghmos) its taker in Hellfire if he/she doesn`t seek repentance, and he/she has to expiate for that oath. You should avoid any doubtful acts so that your husband`s chest remains clear from the evil suggestions of the devil.

Relieving the People of Gaza is a Legal Obligation

"In the name of Allah, the Most Gracious, the Most Merciful"

Abu Hurairah [RAA) narrated that the Messenger of Allah (PBUH) said:

“……. A Muslim is a Muslim’s brother. He does not wrong, desert or despise him……..” {Related by Muslim}.

The General Iftaa` Department extends its sincere thanks to the Jordan Hashemite Charity Organization and the Royal Medical Services for their fulfillment of the collective obligation incumbent on all Muslims, and their continuous and organized provision to our brothers in Gaza - based on the royal directives - with some of the requirements of daily life: food, medicine, treatment, and clothing. This helps our brothers in Gaza to stand firm in the face of the difficult circumstances they face.

We urge all Muslims to cooperate with the Jordan Hashemite Charity Organization in sending aid to our people in Gaza. Indeed, it is Allah Who grants success.

Are minors (persons under the age of puberty) obliged to fast?

A male under the age of puberty isn`t required to fast, but his guardian should order him to fast if he was able to endure the hardship until he gets used to it. And Allah Knows Best.

Should a minor fulfill his vow?

The vow of a minor is countless because he isn`t required to meet the Sharia rulings at such an age, and it is desirable for him to fulfill that vow once he reaches puberty.

I work for a company whose manager refuses to allow employees to leave during work hours. Do I incur sin if I secretly went out to join the congregation at the Masjid? Is doing so considered a breach of trust?

Praise be to the Lord of the Worlds.

We recommend that you pray at work to encourage your colleagues to follow suit, because whoever guides to good has the like of the reward of the person who actually does it. And Allah The Almighty Knows Best.

Is it permissible to divide the Aqeeqah amongst one`s brothers and family?

Giving a portion of the Aqeeqah, even a small one, to the poor and needy is obligatory, and if one`s brothers and family are among the needy then, they are more entitled to it, and this way it is a charity and an observation of kinship ties. However, if they aren`t needy then, it is permissible to give them from the Aqeeqah after giving the poor and needy their share.
