The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. What is the ruling on having brotherly ties between a strange man and a strange woman, and is the former considered a Mahram(unmarriageable) to the latter?

Such a relation between a strange man and a strange woman is forbidden in Islam because it involves forbidding what Allah has allowed by marriage, and allowing what Allah has forbidden such as looking and the like. Such a relation doesn`t render any act lawful between them, thus they are forbidden to look at each other, have a Khulwah(seclusion), and travel together.

A man has married a second wife and deprived the first from provision and overnight stay. He spent most of his time and wealth on his second wife. After sometime, the latter got sick and was diagnosed with breast cancer, which made him forsake her in bed and return to his first wife. What is the position of Sharia on this?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon Prophet Mohammad and upon all his family and companions.

It is forbidden for a woman to forsake her husband in bed without a lawful excuse since this is one of the mutual rights of spouses. When the wife abstains from making love to her husband without a lawful excuse, she is considered sinful. This is because the Prophet (PBUH) said: "If a woman spends the night deserting her husband's bed (does not sleep with him), then the angels send their curses on her till she comes back (to her husband)." [Agreed upon]. And Allah The Almighty Knows Best.

Is the `Iddah (waiting period) of the divorced effective from the time the divorce took place, or from the time of registering it at the court?

It is considered effective from the time the divorce took place, and not from the time of registering it at the court.

Is it permissible for the guardian to give Sadaqa( voluntary charity )from the money of the orphans?

It is impermissible for the guardian to donate from the money of the orphans because he is entrusted with the safekeeping of that money, and is prohibited from donating it.

Relieving the People of Gaza is a Legal Obligation

"In the name of Allah, the Most Gracious, the Most Merciful"

Abu Hurairah [RAA) narrated that the Messenger of Allah (PBUH) said:

“……. A Muslim is a Muslim’s brother. He does not wrong, desert or despise him……..” {Related by Muslim}.

The General Iftaa` Department extends its sincere thanks to the Jordan Hashemite Charity Organization and the Royal Medical Services for their fulfillment of the collective obligation incumbent on all Muslims, and their continuous and organized provision to our brothers in Gaza - based on the royal directives - with some of the requirements of daily life: food, medicine, treatment, and clothing. This helps our brothers in Gaza to stand firm in the face of the difficult circumstances they face.

We urge all Muslims to cooperate with the Jordan Hashemite Charity Organization in sending aid to our people in Gaza. Indeed, it is Allah Who grants success.

How long is the` Iddah(waiting period) of a divorced woman?

If a woman is pregnant at the time of divorce, then her 'Iddah (waiting period) expires when she gives birth to the baby. If she is in a state of menstruation, then her `Iddah expires when she finishes three menses. However, if she doesn`t have menses, then her `Iddah expires after three months.

Is it permissible for the wife to give the Zakah(obligatory charity) of her money to her poor husband?

Yes, it is permissible for the wife to give from the Zakah of her money to her poor husband.

I married a man and had two children; however, we got separated four years ago. In addition, my husband`s brother, paternal uncle of my children, has been providing for them ever since. In fact, he is an honest, well-behaved man. Is it permissible that we get married although his brother (My ex-husband) is still alive?

It is temporarily prohibited for a woman to marry her stepbrother. Therefore, once she receives Talaq Ba`in (Irrevocable divorce), she is allowed to marry her stepbrother, even if his brother (First husband) is still alive. And Allah The Almighty Knows Best.

What is the ruling on shaving the head of the newborn?

It is desirable to shave the head of the newborn on the seventh day from delivery, and the weight of his/her hair is given in gold , or silver as charity.
