About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. 1- A young man whose father and grandfather are dead. Unfortuntly, he passedaway leaving a mother, two sisters and a brother. Do his paternal uncles inherit him? 2- A man died leaving daughters, a wife, brothers, a mother or no mother. It is well known that the daughters inherit two thirds and the wife one eighth. To whom does the rest of the estate go and what is the evidence on that from the texts of Sharia?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

1- The full brother or the paternal half-sibling disinherits the paternal uncles. The paternal half-sibling takes one sixth and because they are from the Asabah (Male relatives on the father`s side) of the deceased they take the rest of the estate. The proof of this is that Ibn ‘Abbas (May Allah Be Pleased with them) reported God’s Messenger (PBUH) as saying: "Give the shares to those who are entitled to them, and what remains over goes to the nearest male heir." [Agreed upon]. In this case, nothing is left to them.

2- The brothers take the rest of the deceased`s estate and the full brother disinherits the paternal half-sibling, and the proof of this is the aforementioned narration. And Allah The Almighty Knows Best.

I`m a god-fearing woman. I`m two months pregnant but my husband insists that I have an abortion?

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

It isn`t permissible for you to abort the fetus unless it endangers the mother`s life. Therefore, try to convince your husband to change his mind and encourage him to pay us a visit. And Allah The Almighty Knows Best.

Am I permitted to perform more than one prayer within single ablution?

You are permitted to pray as many as you could within one ablution and to recite Quran so long as your ablution isn't nullified.

Is it disliked to clip one`s nails at night, and is it permissible to burn them afterwards?

It is desirable to bury the cut hair and the clipped nails. As for burning clipped nails, there is no evidence forbidding that , but it is better to suffice with the aforesaid ruling-burying cut hair and clipped nails-as it is based on a well known evidence.

Statement over the Incident in Karak

All perfect praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Mohammad and upon all his family and companions:

"Think not of those who are slain in God’s way as dead. Nay, they live, finding their sustenance in the presence of their Lord; They rejoice in the bounty provided by God: And with regard to those left behind, who have not yet joined them (in their bliss), the (Martyrs) glory in the fact that on them is no fear, nor have they (cause to) grieve. They glory in the Grace and the bounty from God, and in the fact that God suffereth not the reward of the Faithful to be lost (in the least)." [Al-Imran/169-171].

The General Iftaa` Department mourns for the martyrs of the Jordanian civilians, the public security forces, and the gendarmerie who have sacrificed their souls in God`s way while defending their country, in the city of Karak. We pray that Allah accepts them with the Prophets, the truthful, the martyrs, and the righteous. Indeed, they are in the company of those on whom is the Grace of God.

Through the tremendous efforts of its truthful men and sincere citizens, Jordan will remain steadfast against whosoever attempts to undermine its peace and stability.

The Department calls upon all Jordanians to stand by the security forces as well as the wise, Hashemite leadership, presided by His Majesty King Abdullah the second, May Allah protect him, against extremists and outlaws.

The Department expresses its deepest condolences to King Abdullah and the families of the martyrs, praying that Allah blesses them with mercy and forgiveness, and their families with patience and solace. To God we belong and to him is our return." And soon will the unjust assailants know what vicissitudes their affairs will take!" [Ash-Shu'ara'/227].

Is it permissible for a person who has to make up for missed fasts to fast six days of Shawal(the month directly after Ramdhaan) before making up for the missed fasts ?

Yes, it is permissible for him/her to do so, but it is better that they make up for missed fasts first.

Is it permissible for a woman to ride a taxi without a Mahram(unmarriageable kin) in order to attend a gathering of knowledge?

It is permissible for the woman to pursue the knowledge that she needs in order to perform the religious requirements due on her if there was nobody to teach her at home, provided that there is no temptation involved. Moreover, we don`t recommend that she rides a taxi without a Mahram although such an act isn`t from the forbidden Khulwah(seclusion).

Is it permissible for a Muslim physician to specialize in GYNECOLOGY OBSTETRICS, and what is the ruling on working as such?

Some fields of knowledge are an individual duty while others are a collective one, and specializing in GYNECOLOGY OBSTETRICS is a collective duty. However, if there were female physicians to treat women, then there is no need for a male GYNECOLOGY OBSTETRICS specialist to look at women`s Awrahs (private parts) except in necessary situations since the jurisprudential maxim says:” Necessity must only be assessed and answered proportionately.”

Who are the blood-relatives with whom kinship ties should be maintained?

Blood-relatives are those from the side of one`s father and mother: grandfathers, grandmothers, uncles, and aunts.
