Beirut Declaration for a Clear Religious Information

 

On Dec. 21st, 2015, the Muftis of the Sunni community in Egypt, Jordan and Lebanon signed a joint declaration. It is entitled the "Beirut Declaration for a Clear Religious Information", and it reads as follows:

In light of the aggravating phenomenon of extremism in the Arab and Muslim countries, its employment of social media to instigate killing, exemplary punishment and labeling others with disbelief (Takfir), which belittles religions, manners, principles of communal living, private and public freedoms, the tendencies of the youth, the image of Islam and the Arabs before the world and taking into consideration that the religious invitation is a plain statement to communities and the whole world, the above Muftis, out of their religious and brotherly ties, address the Arab, Muslim and international audience with the following statement which includes five points:

 

First: Renewed commitment to the development of a moderate and reforming religious discourse including the propagation of the values of tolerance and moderation, the strengthening of peace in the society, the re-establishment of trust between generations, support for traditions of communal living and arriving at mutual terms with the world.

 

Second: Renewed commitment to the development of a clear religious information that includes the values of acceptance of others at a religious, national or global level, as well as the peaceful resolution of differences in a space of equal and mutual trust.

 

Third: Cooperation between the departments empowered to issue religious decrees (fatwa) in Egypt, Jordan and Lebanon, at the level of exchange of information and experiences, mutual visits, to combat religious extremism and all other extremists who threaten the security of Arab societies, their unity and their stability.

 

Fourth: Cooperation between Muslim and Christian religious leaders in the setting up of an observatory of coexistence, which will be based in Beirut.

 

Fifth: The exhortation addressed to the Arab media, private and public, to responsibly report religious information, leaving aside anything that may exacerbate religious sensitivities in a context of discrimination and misinformation. It should also be noted that the first and second points of the declaration deal respectively with sermons in mosques as well as current and widespread religious information in the media.

 

Lebanon has always been a country of religious freedoms, equal and responsible coexistence as well as clear and advanced information. At an era of revolutionized media and means of communication, we hope that Beirut will play a pioneering and clear role in promoting values of political moderation and social stability from the perspective of religious values as well as help the world to create an open image about the Arabs and Muslims.

Is Zakah (obligatory charity) obligatory on indebted merchant?

Debt doesn`t abrogate the dueness of Zakah, thus a debtor who has money, articles of merchandise, or other Zakah funds at his disposal should pay their Zakah.

I placed my hand on the Quran and made an oath to avoid doing a specific matter, but the devil seduced me. What is the ruling on this?

You are obliged to pay an expiation; feeding 10 poor and the cost of feeing one is half JD. And Allah Knows Best.

What is the best charity to offer on behalf of the deceased? Is it giving food, reciting Quran, giving money or supplicating? What is the best charity to offer on behalf of dead father and dead husband? What is the best continuous charity to offer on behalf of the deceased?

Praise be to Allah the Lord of the Worlds. The deceased benefits from every righteous deed offered on his/her behalf, be that continuous charity, reciting Quran or a pious son praying for him/her. However, the best righteous deed is performing Haj and Omrah on their behalf especially if he/she hadn`t performed that ritual for it remains a debt on them. The evidence on this is that Ibn 'Abbas (Allah be pleased with them) reported: A man came to the Messenger of Allah (PBUH) and said: "Messenger of Allah, my mother has died (in a state) that she had to observe fasts of a month (of Ramadan). Should I complete (them) on her behalf? Thereupon he (the Holy Prophet) said: Would you not pay the debt if your mother had died (without paying it)? He said: Yes. He (the Holy Prophet) said: The debt of Allah deserves more that it should be paid."{Related by Muslim}. And Allah the Almighty knows best.

I`m married to an American citizen who used to be married to a man in Mexico and filed for divorce there. It is worth pointing that in America she isn`t registered as married. When she arrived in Jordan, her lawyer called and told her that she got the divorce, and based on this we got married in Jordan. What is the ruling of Sharia on this?

All perfect praise be to Allah the Lord of The Worlds. May His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.
 
You haven`t mentioned whether this woman has converted to Islam or not. If she had embraced Islam and three menstrual cycles passed, but her first husband hasn`t converted to Islam, then her relationship with him is over. If you married her after this (Passing of three menstrual cycles and first husband not having embraced Islam) then your marriage is valid. However, if she didn`t convert to Islam then your marriage contract with her is invalid and you have to wait until she gets divorced by her first husband and observes Iddah, which is three menstrual cycles. Afterwards, you can conclude the marriage contract. We pray that Allah doesn`t hold you to account for what you have done because you thought she was divorced. We recommend that you seek Allah`s forgiveness as much as you can and do righteous deeds. We also advise you to marry a Muslim woman to preserve your and your children`s religion since Almighty Allah Says (What means): "Wed not idolatresses till they believe…" [Al-Baqarah/ 221]. It is true that marrying a Kitabi (One who believes in a book of sacred scriptures and with whom a Muslim may marry in what is deemed a lawful marriage) is permissible, it involves great risks, as stated in the aforementioned verse. And Allah The Almighty Knows Best.
