About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. There is a car dealership, and their method of selling is as follows: The customer pays the full price of the car, the car is registered in their name, and another contract is written in which the company commits to refunding the full price of the car to the customer after one year from the purchase date. What is the Islamic ruling on this transaction?

As for purchasing the car, paying its price, and owning it, this is a valid sale with no issue. However, the condition of refunding the price — whether the car is returned to the seller or not — is an invalid condition that nullifies the entire contract. Therefore, this transaction is invalid and not permissible. And Allah Knows Best.

What`s the ruling on using the following materials in manufacturing cosmetics: olive oil, Vaseline, talc powder, glycerin, honey, almond oil, pine oil, galingale and marjoram?

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions. None of the above materials is forbidden, and it`s lawful to use them in manufacturing products that are beneficial to people. This is because, in principle, all things are lawful so long as there is no evidence in Sharia indicating otherwise. And Allah Knows Best.

During Ramadan, a man had sexual intercourse with his wife. What is the expiation for that? And is he permitted to pay the expiation?

If a man has intercourse with his wife during the daytime in Ramadan, he must make up for that day and offer expiation. The expiation is fasting for two consecutive months. If he is unable to do so, he must feed sixty needy people. And Allah Knows Best.

Is it permissible to donate corneas to Jordan Eye Bank or all the organs via telephone?

Corneas donation that is carried out after one's death is permissible by the Board of Iftaa'. Because this procedure is highly sensitive, the donation process

should undergoes to an accredited mechanism. And Allah, The Exalted, Knows Best

I married a man and had two children; however, we got separated four years ago. In addition, my husband`s brother, paternal uncle of my children, has been providing for them ever since. In fact, he is an honest, well-behaved man. Is it permissible that we get married although his brother (My ex-husband) is still alive?

It is temporarily prohibited for a woman to marry her stepbrother. Therefore, once she receives Talaq Ba`in (Irrevocable divorce), she is allowed to marry her stepbrother, even if his brother (First husband) is still alive. And Allah The Almighty Knows Best.

Does touching one's wife invalidate ablution?

Touching the wife according to the Shafi'ee's doctrine invalidate husband's ablution. And Allah Knows Best.

Is permissible to buy/sell with non-Muslim?

Yes buying/selling for a Muslim with non-Muslim is permissible as regards what is lawful.

Is Fajr (dawn) Sunnah a confirmed one?

All praise be to Allah The Lord of The Worlds Of course, it is a confirmed Sunna which the Prophet (PBUH) used to offer in a regular basis. And Allah Knows Best.
